Redmond, Washington motorcyclist killed in crash

The Seattle Times reports that a 31-year-old Redmond man died in a motorcycle accident this morning after his motorcycle hit a curb and he was thrown off the bike.

Redmond police are investigating the accident but they believe the motorcyclist was traveling at a high rate of speed.

A previous blog reported that the Washington State Patrol says 80% of motorcycle fatalities are accidents which do not involve another vehicle and that excessive speed is often the cause of the accident.

Washington State Patrol says most motorcycle deaths caused by rider error

The Washington State Patrol (WSP) has issued a media release saying that new data on motorcycle accident deaths shows that 80% of fatal motorcycle collisions are the fault of the rider. According to State Patrol Chief John R. Batiste, "half of fatal collisions don't even involve a second vehicle."

The Patrol says that most deaths are caused by "easily correctable errors". These correctable errors are:
seattle and bellevue motorcycle lawyer

  • Excessive speed
  • Errors in lane travel which result in hitting a fixed object like a guard rail, sign or tree or hitting oncoming traffic.

Batiste says that if riders slowed down, they would save their own life. He also said that inexperience is another cause of deaths. Statistics show that half of the riders who die do not have a motorcycle endorsement on their license. While motor vehicle fatalities are down overall, motorcycle fatalities are slightly up this year with 48 riders being killed this year compared to 43 for the same time period in 2007 and 59 in 2006.

WSP says they are going to enforce the law requiring a motorcycle endorsement. If they stop a motorcyclist and the cyclist does not have the endorsement, they will ticket the rider and probably impound the bike. To help riders get the endorsement, the Department of Licensing is offering additional courses in rider safety.

For information on obtaining your motorcycle endorsement, see the Washington State Department of Licensing web-site.

When is a rear-end accident not the following driver's fault?

The Seattle Post-Intelligencer had an interesting Question posed to Washington State Patrol officer, Keith Trowbridge, who writes a blog for the P-I. The question posed was basically, In a rear-end collision, is it always the following driver's fault?

According to Officer Trowbridge, the State Patrol will use their discretion at determining fault by looking at "the totality of the circumstances." He did caution that most people who rear-end other vehicles are usually at fault and usually cited. That said, here are some examples of where the following driver wouldn't be cited:

  • Unsafe lane change -- if someone changes lanes in front of you and brakes at the same time.
  • When your are stopped in traffic and someone rear-ends you, causing you to rear-end the vehicle in front of you.
  • When the driver you rear-end is a scam artist. Sometimes a scam artist will drive an "old beater" car and cause people to rear end them to collect insurance money.

Negligence in any car accident usually is based upon a violation of the "rules of the road," which are the Washington State motor vehicle codes that regulate driving. Who's at fault in Seattle pedicab accident?

Our previous Blog Posting reported on the recent pedicab accident that occurred in Seattle's Belltown neighborhood. In that tragic accident, a pedicab apparently went through a red light on a steep hill, collided with a car, resulting in the death of a tourist and injuring his wife and the pedicab operator.

We presume that the investigation into the accident's cause is still ongoing and our deepest sympathies go out to the victims of this tragic accident. The question on a lot of people's minds is, "Whose at fault?"

Lingering questions remain:

  • Did the pedicab fail to provide proper training for their drivers? Are drivers cautioned about hilly streets and also the amount of weight a cab can carry and shave the brakes function correctly?

  • Did the company have approved and non-approved routes? Was the driver allowed to drive on this hilly route with a steep grade?

  • Was brake failure the cause? If so, were the brakes rated to work with the load it was carrying? Were the brakes properly maintained?

  • Was the pedicab operating the cab in a safe manner? Was he negligent in any way in the operation of the vehicle?

Seattle's, The Stranger, wrote an article entitled The Fall Guy which is well worth reading. In the article, Eli Sanders interviews a former pedicab driver who believes the accident was "caused by shoddy maintenance and lax safety."

The Belltowner also is blog where people are commenting on the accident. You might want to read that too.

For now, we hope the victims are recovering from the injuries.

For the future, we hope the investigation pinpoints the exact cause of the accident and then steps be taken so this tragic accident is not repeated.

Fatal motor vehicle accidents down 10% in Washington State

The National Highway Traffic Safety Administration (NHTSA) has just released a statistical summary of traffic safety for the year 2007. According to the report, more than 41,000 Americans were killed in motor vehicle accidents in 2007 and more than 2.49 million people were injured.

seattle personal injury attorneyThe good news is that the number of fatal motor vehicle accidents has decreased by 10% in Washington State where there were 568 fatal motor vehicle accidents in 2007 compared with 633 accidents in 2006.

The bad news is that the number of motorcycle accident fatalities continues to rise. Motorcycle accident fatalities across the States account for 13% of the total fatalities and went up 17% over all.

Fatalities caused by a drunk driver decreased by 3.7% with 13,000 deaths attributed to someone driving under the influence.

The report notes that, in the United States, there were 4,654 pedestrians killed in 2007 and 698 bicyclists were killed.

Trucking accident fatalities remained about the same from the previous year.

Traffic injuries and death may be down because Americans are driving less with gas prices being so high. The concern is that, as more people ride bicycles and motorcycles to avoid high gas prices, accidents and fatalities in this group may continue to rise.

50 fatal accidents on U.S. Highway 2 in Washington in 9 years

The Everett Herald Net reports that there have been 50 fatal motor vehicle accidents on the section of US Highway 2 between Snohomish and Stevens Pass since 1999. Antonio Miranda, who died this past weekend, had the dubious distinction of being the 50th fatal accident victim when his car crossed over the center line. His accident was one of 18 fatal "crossover" accidents where a car crossed over the center line.

highway 2 car accident washingtonGovernor Christine Gregoire has designated US 2 as a "traffic safety corridor" which is the Washington Traffic Safety Commission working with the Washington State Department of Transportation and the Washington State Patrol to address low-cost, short-term solutions to problems on the roadways in order to reduce fatal and disabling motor vehicle accidents.

US 2 is a vital east-west link across the Cascade Mountains. It is used as a major transportation corridor, ferrying agricultural products and container shipments from the port of Seattle and Tacoma. It also provides access to the Cascade mountains for thousands of people engaged in outdoor activities like camping, hiking, skiing and fishing.

The US 2 Safety Coalition was formed after several traffic deaths in eastern Snohomish County. The coalition was formed to raise awareness of hazards on US 2, decrease gridlock on the highway and make the highway safer. The Coalition also raises money for road improvements. The Coalition views Highway 2 as a vital link in Puget Sound's economic development and they insist that Highway 2 improvements need to be higher on the priority list of the legislature.

The Safety Coalition would like to see the highway widened to four lines with a divider.

We would like to see the carnage on Highway 2 end as well. As Washington Personal Injury Attorneys specializing in car accident cases, we aim to raise awareness about the causes of motor vehicle accidents and we have written far too often about deaths and serious personal injuries that have occurred on Highway 2.

Seattle pedicab accident kills tourist

The Seattle Times reports that a tourist was killed and five people were injured when a pedicab ran a red light and collided with van in Belltown. Peter Dzioba, 60, of Watertown, Connecticut was killed in the accident. His wife, Mary Dzioba, was taken to Harborview Medical Center in Seattle where she listed in satisfactory condition. The pedicab driver, a 23-year-old Seattle man was also listed in satisfactory condition.

The Dzioba's were visiting Seattle to celebrate their 25th wedding anniversary and were scheduled to take an Alaskan cruise.

The accident occurred in the Belltown section of Seattle on Cedar Street between First and Western. This area of Seattle has a steep grade. According to the report, the pedicab may have ran a red light and hit a scooter and then crashed into a minivan. Peter Dzioba was crushed under the van and was pronounced dead at the scene.

A pedicab is a tricycle with a rear seat for passengers. They are not regulated in Seattle. This is the first pedicab related death in the area. The pedicab involved in the accident is owned by Cascadia Cabs. The owner of the company, Ryan Hashagen, owns a fleet of 46 cabs and operates them in cities from Eugene, Oregon to Vancouver, B.C. The 17 that are operated in Seattle mostly traverse a route along the waterfront and around Seattle Center and the Sodo district.

The cause of the accident is being investigated. Speculation on the cause is that the brakes on the pedicab failed or that they were not designed for the load it was carrying on such a steep grade.

The article tells about how determined and positive the sisters are and their plans for their future. (Read the full text of The News Tribune article here.)

William Hominger of Bonney Lake was convicted of vehicular assault because he was driving drunk at the time of the accident and was trying to pass another car going 70 mph. He spent time in prison.

The story of these two courageous sisters is not unlike many stories of the victims we represent as personal injury attorneys. Personal injury attorneys care about their clients. We have seen far too many times how people are seriously injured or killed through the negligence of another person. Some injuries take years to heal, and some never heal.

As a personal injury attorney working with an accident victim, we have doctors and physical therapists who provide estimates on how much future care and rehabilitation a victim will require. Some victims need their house remodeled so that doors can be widened and counters lowered to accommodate a wheelchair. In other cases, the victim is on permanent disability and should be compensated for loss of wages. Some victims who have suffered a brain injury need extensive rehabilitation and a care giver. Victims need to be compensated for their past and future medical costs but also for the cost of rehabilitation and costs of accommodations required for living with their disability. Victims also need to be compensated for their pain and suffering.

Often the media portrays personal injury attorney in a negative light. At The Farber Law Group we work to insure that our clients are fairly compensated for their injuries. And, we represent our clients on a contingent fee basis, not charging any attorneys fees unless we collect compensation for you.
