DUI driver sentenced to 90 days in car accident that killed 2

KOMONews.com reports that Amanda Schroeder, who pleaded guilty to driving under the influence and possession of alcohol as a minor after an accident where two sisters were killed, has been sentenced to 90 days in jail and given 5 years probation for the DUI. Her driver's license was also suspended for 90 days.

Schroeder was involved in the June 2007 crash that killed Tina Garcia and Renee Nunez, two sisters. Nunez was the mother of four children.

Prosecutors struck a plea deal with Schroeder because new findings in the case confirmed that the victims' car was in the intersection on a red light and that the driver had THC in her system and her passenger had alcohol in hers.

Nearly 45% of the 700 traffic fatalities in Washington State last year involved alcohol. The Washington State Legislature enacted the drunk driving law which sets the BAC (Blood Alcohol Content) as 0.08 percent.

Boating accident on Lake Tapps kills one, injures nine

One person is dead and nine people injured after a motor boat collision on Lake Tapps in Pierce County, Washington.

According to the East Pierce Fire & Rescue department, two boats collided around 10:37 pm between Inlet Island and Interlake Island. Witnesses said they saw one boat traveling at an estimated 25 mph before the crash; Lake Tapps has a "no wake" rule after dark which stipulates that no boat can travel more than 5 mph.

From piecing together reports from The Seattle Times, King5TV.com and KOMOTV.com, it appears as if one boat was speeding and crashed into and over the other boat, throwing the driver of the second boat into the water and injuring all the people on board the boat that was hit. Divers later found the driver's body using underwater cameras.

Of the nine people injured, two people are in critical condition and one is in serious condition. The injured were taken to Harborview Medical Centert in Seattle, Tacoma General Hospital, Samaritan Hospital in Puyallup and Madigan Army Medical Center.

The operator of the alleged speeding boat may have been boating under the influence. He was arrested and booked into Pierce County Jail for investigation of vehicular homicide and vehicular assault. Vehicular homicide may be charged if someone dies as a result of negligent operation of a vehicle while the driver was under the influence of alcohol or drugs at the time of the accident or if the operator was driving recklessly. Vehicular assault can be charged if someone is seriously injured while a person was driving recklessly or under the influence of alcohol or drugs.

This is the second boating tragedy with a fatality and multiple serious injuries within the past three days in the greater Seattle area. In the other accident, a beloved Bellevue Middle School Music teacher, Heather DeHart, 38, of Bothell was killed after a speeding boat hit the sailboat that she was on.

Everett woman critically injured in pedestrian accident when car leaves road

A 50-year-old woman was critically injured in a pedestrian accident on Friday when a car driven by a 29-year-old woman went off the road and hit her. The victim was taken to Harborview Medical Center in Seattle for treatment of her injuries; Her condition is unknown.

The accident occurred around 4pm in the 12900 block of Eighth Avenue West according to the Seattle Post Intelligencer.

The Snohomish County Sheriff's Office is investigating the accident. It is not known whether the woman driving the Nissan pathfinder was under the influence, distracted by a cell phone or experienced a medical emergency.

Woman killed, four injured when motorboat hits sailboat on Lake Washington

A woman was killed and four people were injured in a boating accident when a motorboat, driven by a 17-year-old male, hit a sailboat on Lake Washington on Saturday evening around 8:30pm reports KOMONews.com.

The woman, who was killed, was a passenger on the sailboat when she was thrown overboard by the collision. The woman may have been hit by the power boat again when she was in the water. She was dead at the scene.

The 17-year-old driver of the motorboat and his 16-year-old passenger were both taken to Harborview Medical Center in Seattle for treatment of their injuries. Two other people on the sailboat may have been injured.

Police are investigating what led up to the accident.

In Washington State there are between 20-30 fatalities a year and 4,000 injuries from boating accidents per year.

Correct position of child safety seats reduces car accident injury by 43 percent

Parents who place their child's car seat in the middle of the back seat rather than on the sides, are keeping their children safe in case of a car accident. By positioning a child's car seat in the middle of the rear seat, the child is 43% less likely to be injured in a car accident according to a University of Pennsylvania and Children's hospital of Philadelphia study which was published in the journal Pediatrics.

The study looked at data from 4,790 automobile accidents which involved children under the age of three. They found that only 28 percent of car seats are placed in the middle rear seat. They found that the center position is always recommended but that there is a low compliance.

Woman killed, man injured in Seattle car accident

One person was injured and a 57-year-old woman died after a roll-over car accident which occurred on Friday morning in the Broadview area of Seattle, Washington according to the Seattle Post Intelligencer. The woman, who was a passenger in a Subaru, was taken to Harborview Medical Center where she died of her injuries. The driver of the Subaru was taken to Harborview with what the report described as "minor injuries."

The man driving the second car involved in the accident, a Jeep, was not injured.

According to the Fire Department, the accident occurred about 11:45 am at North 1278th Street and Greenwood Avenue North in Broadview.

The cause of the accident is being investigated but police do not believe that alcohol or drugs were a factor.

Concrete barriers to be installed on dangerous 10 mile stretch on I-5 near Marysville

The Washington State Department of Transportation will replace cable barriers with concrete barriers next year on northbound Interstate 5 near Marysville reports The Seattle Times. A Washington State Department of Transportation Report (WSDOT), along with the Washington State Patrol (WSP), recommended that concrete barriers be built on northbound lanes and allow cable barriers to remain on southbound lanes. In the past seven years, eight people have been killed in cross over collisions where vehicles went through the guardrails in one 10 mile stretch of Interstate 5.

The report says, "apart from special circumstances in Marysville, cable median barrier has performed excellently and saved many live on state highways in Washington." It also says, "apart from the 10-mile stretch of I-5 in Marysville, not a single crossover fatality has been recorded on Washington's freeway in locations where cable median barrier has been installed."

Critics of the cable barriers say that they are the least expensive to install but maintenance is expensive and there are safer alternatives including guard rails and concrete barriers.

Senior citizen dies from injuries in West Seattle pedestrian accident

The Seattle Times reports that a 92-year-old woman, Rosemary MacCorkindale, died of her injuries after being hit by a vehicle while crossing a street in West Seattle. The pedestrian accident occurred on California Avenue Southwest near Southwest Dawson street around 1pm on Monday.

The Fire Department transported the woman to Harborview Medical Center where she died .

The vehicle that struck MacCorkindale was a Buck sedan driven by a 77-year-old woman. The driver has not been cited but the cause of the accident is under investigation.

Shelton, WA car accident claims the lives of 2 men, driver booked on investigation of vehicular homicide & assault

Aaron J. Robinson, 24, of Shelton has been arrested and booked for investigation of vehicular homicide and vehicular assault after he was involved in a single car accident which resulted in two deaths.

According to a report on KiroTV.com, Robinson was driving a 1991 GMC Jimmy with seven people inside when he ran a stop sign on early Sunday morning. His car eventually careened down an embankment.

Killed were Albert B. Legault, 30, and John Evan Liptak, 21. Both men were pronounced dead at the scene. Three other passengers were taken to Mason General Hospital with "non-life threatening injuries." Robinson was treated for minor injuries before he was booked.

Vehicular Assault can be charged if a person was seriously injured while a driver was driving recklessly, under the influence or without regard to the safety of others.

Vehicular Homicide can be charged if a person dies as a result of negligent operation of a motor vehicle or dies of their injuries within three years of the incident.

Suit can be brought for wrongful death by the families of those killed.

North Bend, Washington man killed in car accident on I-5 in Everett

Washington State Patrol trooper, Keith Leary, reports that a North Bend man died in a rollover car crash on the I-5 near the Everett Mall and the Silver Lake rest area.

The accident which occurred at 3:30am shut down the South Bound I-5 for three hours.This is the third fatal car accident on the I-5 in Snohomish County this year.

According to a report in the Everett Herald Net, the man who was driving in a 94 Isuzu Rodeo SUV, clipped the front left corner of a FedEx semi truck while changing lanes. The SUV went off the roadway, rolled over and the driver was thrown out and killed. The driver of the semi was not hurt.

Police believe that weather and alcohol may have been factors in the accident. They are currently investigating.

Sumner, Washington bicyclist killed by dump truck

The Seattle Post Intelligencer reports that a 22-year-old bicyclist was killed in a freak bicycle accident with a dump truck on Thursday morning in Sumner. Apparently, the man who was riding in the 14200 block of Eight Street East on his way to work, wiped out on the gravel shoulder of the road. He fell into the path of a oncoming dump drunk who was unable to stop.

The bicyclist was killed at the scene.

Bicyclist injured after being hit by car in South Seattle

KiroTV.com reports that a bicyclist received serious injuries after being hit by a car near the intersection of South Jackson Street and 7th Avenue South in Seattle around 10am. The bicyclist, a man in his 20's, was taken to Harborview Medical Center in Seattle.

Vancouver, WA motorcycle accident injures man

KOMO News.com reports that the force of impact between a motorcycle and a automobile launched the motorcyclist into the air where he landed 20' away after knocking down a high school student waiting for the bus.

According to the report, Christopher Elston, 24, of Vanouver was heading north on Northeast 159th Avenue when a Saturn turned left onto Northeast 73rd Street directly in front of him. The Suzuki motorcycle hit the Saturn and launched Elston into the air.

Elston was taken to Southwest Washington Medical Center for treatment of a compound fracture to his left leg. His injuries are described as "serious." The high school student was apparently only stunned, not injured.

The police are investigating the accident to determine if anyone should be cited.

It appears as if the Saturn failed to yield the right of way to Elston. WPI 70.0201, provides that a driver intending to turn left within an intersection shall yield the right of way to any vehicle approaching from the opposite direction which is within or close to the intersection that the turn would create an immediate hazard. The primary duty is with the driver turning left to provide a reasonable margin of safety.

Seattle's historic Pioneer Square pergola hit by semi -- again

For those of us that live and work around the greater Seattle area, I wanted to mention this news item that I read in The Seattle Post Intelligencer today.

In historic Pioneer Square in the heart of Seattle, there is a glass and cast wrought iron pergola in a Victorian style which was built in 1909 as a waiting area. In 2001, an 18-wheeled semi clipped the pergola and it came crashing down into thousands of pieces. It took Seidelhuber Iron & Bronze Works of Seattle six months to rebuild the pergola to today's construction standards and they also built a traffic bollard to protect the pergola.

This past Sunday, a semi-trailer would have taken the pergola down again in a near-accident when it made too sharp of a turn and grazed the pergola. The protective bollard that was put in place saved this structure and Seattle collectively sighed in relief.

The truck driver, driving for OJ Ventures Ltd. Of Kamloops, B.C., was too embarrassed to talk about the accident.

Burien woman killed in pedestrian accident

The Seattle Post Intelligencer reports that a 59-year-old Burien woman was struck and killed by a SUV while she was walking on State Route 169 near 196th Avenue Southeast between Renton and Maple Valley around 9 pm on Saturday night.

The Washington State Highway Patrol said that the pedestrian was hit by a 52-year-old Lynnwood woman driving a 20067 Subaru Tribeca. The Patrol is investigating the accident.

Washington State Patrol busts drunk driver in Tacoma using airplane and infrared camera

The Washington State Patrol announced in a press release on Friday that they used an airplane equipped with an video camera with thermal imaging to help apprehend a suspected drunk driver on the I-5 at the South Tacoma extension.

The Patrol said that starting in July 2008, they started using the camera-equipped airplanes to help in DUI enforcement. The program is called "DART" for "DUI Aerial Response Team."

On Wednesday night, troopers in the Patrol airplane saw a Volkswagen weaving in traffic and crossing lane dividers. They coordinated with troopers on the ground to apprehend a 44-year-old Woodland man who was taken into custody for DUI and booked into the Pierce County jail.

“We believe that DART will improve the apprehension rate of drunk drivers reported by
concerned citizens via cell phones”, said Captain Mark Couey with the Special Operations
Division. Chief Pilot, Sergeant Jim Nobach added, “WSP aircraft provide a rapid response to
reported erratically driven vehicles and are seldom out-of-position”.

Puyallup hit-and-run suspect turns self in, released on bail

A man who was being sought after a Puyallup man was killed on Monday in a hit-and-run accident has turned himself in and has been released on bail. Blair Jensen who was being sought by police for three days turned himself in on Friday.

Police suspect Jensen of hitting and killing 51-year-old John "Chip" McRae III who was riding his bicycle on East Maine Street in Puyallup when he was struck and killed by a Cadillac STS. Police say that Jensen owns the Cadillac that hit McRae.

Seattle metro bus hits truck and several passengers injured

The Seattle Times reports that a Metro bus hit a pickup truck that ran a stop sign near Green Lake, at the intersection of Linden Avenue North and North 67th Street on Monday afternoon around 4:15 pm. Several people were hospitalized with neck and back injuries.

Hit and run driver kills bicyclist in Puyallup, Washington

The Seattle Times reports a driver of a Cadillac hit and killed a bicyclist this evening around 8:10 pm in Puyallup and then drove away. The bicyclist is said to be a man in his 50's. He could not be resuscitated and died at the accident scene.

Police are now looking for a late-model Cadillac with possible front-end damage and perhaps broken glass. Some onlookers described the driver as a white male in his 20s.

According to the report, the man had been driving erratically before he hit the bicyclist at the 2600 block of East Main.

According to the report, injuries and fatalities in the trucking industry are more than all other industries combined. The four most common and costly injuries include:

  • Falls
  • Motor vehicle collisions
  • Struck by or against an object

During the period of the report, from 1998-2005, there were 63 trucking fatalities in Washington State, accounting for 10% of work-related fatalities in Washington State. Nearly 80% of the fatalities were in the "general freight" category. Causes of the fatalities included highway accidents, being hit by another truck and tripping on a trailer hitch and falling against concrete.

Trucking is an absolutely vital industry and injuries to truck drivers account for 21,000 lost work time claims in the period of the report and almost 38,000 medical only claims.

Driver arrested for DUI after hitting 2 pedestrians in Yelm, Washington

seattle car accident attorneyThe Olympian reports that a woman and a 14-year-old girl were hit by a car while walking after a football game in Yelm, Washington. The woman and teenage girl both suffered minor injuries; the driver of the car who hit them was arrested for driving under the influence.

The Washington State Legislature set the BAC (blood alcohol content) intoxication standard to 0.08. A person caught driving with that BAC will automatically lose their license. If a driver seriously injures someone while driving under the influence, they can be charged with vehicular assault.

Tukwila, Washington motorcyclist runs into pedestrian, 3 injured

KOMONews.com reports that three people were seriously injured when a motorcyclist driven by a man and carrying a passenger, crashed into a pedestrian.

According to the report, the motorcycle accident occurred on Interurban Avenue near the I-5 overpass in Tukwila, Washington around 10 pm.

The motorcyclist and the pedestrian, a man, were taken to Harborview Medical Center in Seattle with critical injuries. The motorcycle passenger, a woman, was taken to Harborview with serious injuries.

Investigators are trying to determine the cause of the motorcycle accident.

West Seattle pedestrian accident injures teen girl

KOMO News.com reports that a teenage girl was hit by a car on Thursday afternoon in West Seattle. The pedestrian accident occurred around 2:45 when the high school student attempted to cross the street at an unmarked crosswalk. One vehicle stopped for her; another did not.

The report said that the girl was taken to Harborview Medical Center in Seattle. Her condition is unknown.

Seattle teen seriously injured and two others killed in Lewis County car accident

The Seattle Times reports that that a 17-year-old teen was seriously injured in a car accident on Highway 12, east of Morton. The driver of the car, 18-year-old Preston Hopkins of Poulsbo, and another passenger, Larry Chim of SeaTac, were killed.

The accident occurred when the VW Cabriolet the young men were driving and a 26-foot motor home driven by a 63-year-old woman collided. The cause of the accident was not provided.

The injured teen was airlifted to Harborview Medical Center in Seattle. The woman driving the motor home was not injured.

Rollover accident on I-90 injures two men two miles east of Seattle

A rollover car accident just East of Seattle and Bellevue on the I-90 injured a 21-year-old Idaho man and a 25-year-old Ronan, Montana man. The accident occurred on Saturday afternoon around 3 pm.

According to Brad Wong writing for the Seattle Post-Intelligencer, the 21-year-old man was driving the car westbound from Preston and hit the center barrier. His car rolled across the lanes and hit the barrier on the right and then rolled some more. The car landed on its top.

Both accident victims were taken to Overlake Hospital in Bellevue. The accident stopped traffic for a few minutes on the I-90. I drove by the accident site and seeing the car was horrifying.
