Washington State patrol arrests woman twice in February for extreme drunk driving

The Washington State Patrol (WSP) reports that they arrested a Monroe, Washington resident not once but two times in the month of February for extreme drunk driving. In both arrests, the woman's Blood Alcohol Content (BAC) was measured at above a .300%. In Washington State, a BAC of 0.08% is considered legally intoxicated.

car accident and drunk driving accident attorney in seattle
In a media release, the WSP says they first arrested Martha Hernandez, age 26, on February 6th on State Route 522 and she had a BAC of .310%. Hernandez was admitted into the King County Detoxification Center after being processed for DUI.

About three weeks later, on February 24th, found Hernandez passed out in her car. She apparently passed out while driving eastbound on Interstate 90 at mile post 49. Her BAC was measured at the time of her arrest at .357%. She was again booked into King County Jail for Driving Under the Influence.

In Washington State, approximately 45% of all car accident fatalities are alcohol-related. Victims of drunken drivers often suffer horrible injuries including traumatic brain injury, paralysis, or spinal cord damage.

Hopefully, the WSP can convince Ms. Hernandez to stay off the road before she kills or maims someone.

Three Michigan tourists were injured in a pedestrian accident in downtown Seattle on Thursday evening reports The Seattle Times. Two of the injured were taken to Harborview Medical Center in Seattle, one with "life-threatening injuries" and one with "serious" injuries. The third pedestrian suffered a leg injury.

The pedestrian accident occurred at the intersection of Third Avenue and Lenora Street around 9:20pm, about one-half mile from The Farber Law Group's Seattle Office. Washington State Patrol concerned over five fatal motorcycle accidents already in 2009

It's only February 22, 2009 and Washington State has already had its fifth fatal motorcycle accident. In a press release, the Washington State Patrol (WSP) says that they are "alarmed over the high number of fatal crashes occurring so early in 2009." They are hoping this not a trend. Over the last few years, they have seen an increase in motorcycle fatalities: 66 fatal accidents in 2007 and 75 in 2008.

lynnwood motorcycle accident lawyerLast year, the WSP investigated 584 motorcycle accidents and issued citations or warnings to 4,409 motorcycle riders for excessive speed.

When the WSP and the Washington Traffic Safety commission analyze motorcycle accident statistics, they find that in accidents involving just a single vehicle, excessive speed is the number one cause of accidents followed by driving under the influence and the inability to stay in the lane. In fatal motorcycle accidents, around 40% of the riders were found to be under the influence of alcohol.

In Washington State, motorcycle riders are required to have a motorcycle endorsement. The WSP found that in 34% of motorcycle fatalities, the rider did not have the required endorsement. To get an endorsement a motorcycle rider must:

  • Pass a motorcycle knowledge test and pass a motorcycle riding test. Or,
  • Complete an approved rider course at a motorcycle training school.

"Social host liability" laws and serving alcohol to minors

CNN just had an article entitled Officials crack down on booze-serving parents. The article profiled the story of a 16-year-old star football player who was killed in a car accident and police believe he was driving under the influence. They also believe that the teenager had been served alcohol by one of his pal's mothers. If the mother, Kecia Evangela Whitfield, age 43, is convicted she could be required to serve a year in prison as well as pay thousands of dollars in fines.

Increasingly, states are creating "social host liability" laws and imposing heavy penalties on adults who serve alcohol to minors even in their own home. There are a lot of parents who believe that if they allow teenager to drink at home, that it will be safer for the teenagers. Some parents have a belief that if the drinking is done at home then they control binge drinking, and problems associated with it like rape, sexual assault and alcohol poisoning. This belief is becoming a trend in some areas.

In all states, it is legal to give your child alcohol. It is, however, illegal to give another person's child alcohol.

Social Host Liability

In 24 states, legislatures have enacted laws which hold adults who serve or provide alcohol to a minor to be held criminally liable if the minor is killed or injured or kills or injures another person. This law is similar to dram shop laws for businesses.

With dram shop liability, if a person is injured or killed by a drunk driver, then the restaurant, bar or social club that served the obviously intoxicated person can be found negligent as well.

If you or a loved one has been seriously injured, or a loved one been killed by a drunken driver, you should contact the law offices of Herbert G. Farber. Insurance Institute reports some trucks fare worse on side impact crash tests

The Insurance Institute for Highway Safety released a study today which revealed that three pickup trucks had marginal or poor ratings in side impact crash tests. The test results may seem a bit surprising because the three pickup trucks should have an advantage because of their size, weight and height. The three trucks are the Chevrolet Silverado 1500, Dodge Ram 1500, and Nissan Titan.

The side crash tests determines the safety for passengers in crashes with SUVs or pickups. The Insurance Institute can compare side crash test results with other vehicles of the same type and in the same weight category. These three trucks did worse in their results than many of the cars that were tested.

seattle truck accident lawyerThe Institute said that passengers in trucks have a higher seating position and the crash dummies are head and shoulders above the striking barrier. Passengers in cars are usually more vulnerable because their bodies are in line with the front of vehicles that might hit them.

Bellingham woman injured after dump truck loses load on Interstate 5 in Seattle

The Seattle Times reports that a Bellingham woman, age 36, received an eye injury after a dump truck carrying a load of pea gravel dropped part of its load on Interstate 5 in downtown Seattle. Apparently, the gravel hit the passenger side front window of the truck the woman was a passenger in, shattering the window and blowing glass injured the woman's eye.

The car accident occurred in the northbound lanes of Interstate 5 underneath the Washington State Convention and Trade Center.
