Unsecured load crashes into Kirkland woman's car near Marysville

A Kirkland woman, Chrissy Gombos, and her passenger were terrified when an unsecured load from the back of a pickup truck flew out of the truck, hitting her Ford Focus and causing substantial to it on Interstate 5 near Marysville.

Gombos and her companion were headed to Skagit County when a chunk of debris came flying at her car. The front axle of her car was bent and her gas tank punctured from hitting the debris. It seems from the damage to her vehicle, that disaster was narrowly averted. Had the debris gone through her windshield or if she had lost control of her car or it had caught on fire, she might have been seriously injured or killed.

Gombos speculated that the pickup truck driver was unaware that something flew off the truck reports Seattle's KOMO News.com and reporter Ray Lane.

The Washington State Patrol is asking anyone with information about the car accident to contact them.

Washington State has a statute, RCW 46.61.655, which provides a penalty for lost or unsecured loads. Dubbed "Maria's Law" after Maria Federicci, a young woman who was blinded and suffered severe injuries after a piece of particle board fell off a truck and went through her windshield, the statute makes it a second degree misdemeanor to not fasten a load on a vehicle.

In Washington State alone, more than 400 traffic accidents occur every year because of unsecured loads. Heavy objects like furniture and refrigerators, can shift and if they land on another vehicle while traveling at high speeds they can cause severe injury or even death.

It is incumbent on drivers to secure their loads and there are products like TarpX which can make it simple for drivers to do so.

Micro cars not too smart when it comes to accidents

The Seattle Times published a report today about the Insurance Institute for Highway Safety crash tests of some of the mini/micro/smart cars on the market today. Crash test results studies showed that drivers of the micro vehicles face a much higher rate of serious leg and head injuries in front-end car accidents with larger vehicles than people riding in cars often twice as heavy.

The IISHS tested the following cars:tacoma car accident lawyer

  • Smart "fortwo"
  • Honda Fit
  • Toyota Yaris
The IIHS created their tests to simulate a high speed head-on crashes of the micro cars in collisions with vehicles such as a Mercedes C Class, a Honda Accord and a Toyota Camry. The vehicles were tested at collision speeds of 40 miles per hour.

In a auto accident involving the Smart fortwo and the Mercedes C class, the Smart car "went airborne and turned around 450 degrees after striking the C class," reports The Times. The Mercedes came out of the accident relatively unscathed but the fortwo suffered extensive front-end damage and its driver would have received serious injuries.

With higher gasoline prices, many Washington state residents are purchasing the micro cars but one wonders if the trade-off is worth it when it comes to safety in serious accidents.

Texting causes driver to crash into Idaho police car

A driver who was text messaging (also known as "texting") while driving over 60 miles per hour crashed into the back end of a Boise patrol car on Interstate 84 in Meridian, Idaho reports Seattle's KOMO TV News Station.

Luckily, the patrol car was empty at the time of impact but the driver suffered injuries and was taken to St. Luke's Hospital in Meridian for treatment. The injured motorist is a 37-year-old Nampa man. He had been drinking but his blood alcohol limit (BAC) was under the legal limit.

The motor vehicle accident occurred around 10:15 pm when three Boise patrol cars were stopped alongside the road, arresting another motorist for driving under the influence.

Police credit department policies, which had the three patrol cars parked at a distance from one another and the police had the suspect DUI driver off to the side of road, for preventing further injury.

The distracted driver has not been charged at this time. Washington State Vehicle Code has several statutes which provide penalties for sending, reading or writing a text message while driving (RCW 46.61.668) or using a cell phone that is not hands-free while driving (RCW 46.61.667).

If you believe your car accident was caused by a negligent driver using their cell phone, you should contact a personal injury attorney. Highway accident fatality rate at lowest level in 41 years

The National Highway Traffic Safety Administration has announced some great news: highway traffic accident fatalities are at their lowest level since 1961. The fatality rate -- the number of deaths per 100 million vehicle miles -- is the lowest on record at 1.28. Another positive statistics is seat belt usage continues to rise and Washington is one of the top states with 96.5% seat belt use.

There are many factors in the lower fatality rate and these are:

  • Increased seat belt use
  • Increased DUI awareness, education and enforcement
  • Safer vehicles

Of the motor vehicle accident fatalities, approximately 5,154 were motorcyclists, 21,647 were drivers and 8,657 were passengers.

Remove studded tires in Washington by April 1st even though its snowing in Seattle

According to the Washington State Department of Transportation web-site, studded tires must be removed from all motor vehicles by April 1st.

As I sit and write this, it is snowing in the greater Seattle area but the law is the law and studded tires must be removed. According to the WSDOT, both Washington and Oregon has an April 1 deadline for studded tires.

seattle car accident lawyer
Washington State Patrol troopers will write a ticket which has a $124 fine for anyone caught with studded tires after the deadline. People driving on studded tires are easy for the WSP patrol to find as there is a distinctive sound of tires on pavements, and of course, there are the sparks at night time.

The WSDOT warns motorists, however, to anticipate winter driving conditions. The mountain passes such as Interstate 90 at Snoqualmie and State Route 2 at Stevens pass are likely to be treacherous for a few more weeks. WSDOT advises drivers to carry chains and to monitor weather forecasts.
