Teen's text messaging causes rear-end injury accident in Wenatchee

The Wenatchee World reports that a 16-year-old girl caused a rear-end car accident when she hit a car stopped at a light because she was text messaging at the time.

According to the report, the teenager was driving on Western in Wenatchee after 4pm when she rear-ended the stopped car which then was pushed into the stopped car in front of it.

The teenage driver and her 15-year-old passenger were both taken to Central Washington Hospital complaining of neck pain. The car that was rear-ended contained two teens, a 16-year-old driver and a 17-year-old passenger, and they both went to the hospital complaining of neck pain. The driver of the 3rd car was not injured.

Police will cite the teen for following too closely and driving with a passenger that was not a sibling which is in violation of the teen's intermediary driver's license. The police are not going to cite her for RCW 46.61.668 even though she told witnesses that she was texting at the time of the accident.

People who are involved in car accidents, especially a rear-end accident, often complain of neck pain. The common term for this is "whiplash" which describes a hyperflexion/hyperextension injury or a cervical strain/sprain. Often this is a painful injury which requires treatment using ice and heat and physical therapy. If the injury lasts more than 10 days, the condition may be more serious and require a specialist.

It is curious as to why the police did not cite the teenage driver with RCW 46.61.668 which prohibits "Sending, Reading, or Writing a Text Message While Driving." This vehicle code can impose a $101 fine.

If you believe the car accident you were involved with was caused by the other driver's negligent use of a cell phone or other device, you should read "What if my accident is caused by someone using a cell phone?" If your injuries are serious, you should contact a personal injury attorney who specializes in car accidents. With the help of a knowledgeable attorney, you may recover compensation for your damages including pain and suffering.

Traffic safety and children: be vigilant

The National Safety Council mission is "to educate and influence people to prevent accidental injury and death." To that end, they want to let parents, caregivers, and motorists that often the most deadliest car/pedestrian accidents occur in one's own driveway.

Every year, more than 100 children are killed and thousands more are injured when a car backs over them, often in their own driveway. The NSC cautions drivers to walk around their car before backing out and making sure drivers know where children and pets are before backing out.

Now that the temperature is getting warmer in the Seattle-Bellevue-Tacoma metropolitan area, parents, grandparents and caregivers are reminded to not leave a child unattended in a car. In 70º weather, the temperature in a car can rise much higher than that in a short period of time and small children and pets are susceptible to heatstroke which can result in a serious injury including brain injury and even death.

Several times a year, one will read a heart wrenching story about a harried parent forgetting their child and leaving them in the car while they go to work. Some times a change of routine, a harried morning or some other cause will cause the parent to have a lapse and forget their child. The consequences are devastating. The NSC suggests to parents that they do something to remind themselves that a child is in the back seat. For example, a woman could leave her purse in the back seat or a stuffed toy or some other reminder can be placed in the front seat as a reminder.

May is motorcycle safety awareness month

The National Safety Council along with the National Highway Transportation Safety Administration has chosen May as "Motorcycle Safety Awareness Month." Motorcycle safety should be paramount for both motorcyclists and motorists. Across the United States and Washington, there has been a dramatic increase of motorcycle related injury accident and deaths.

In 2007, there were 5,154 fatal motorcycle accidents. This was an increase of nearly 7% over the previous years. Per mile, the likelihood of a fatal motorcycle accident is 35 times more than for drivers of cars and light trucks.

A breakdown of fatal motorcycle accident statistics shows that:
seattle motorcycle accident attorney

  • In 36 of the accidents, speed was involved
  • In 27% of the accidents, alcohol or drugs were involved.
  • Over 90% of fatal motorcycle-car crashes occurred on non-interstate roadways.
  • More than 50% of two-vehicles accidents involving a motorcyclists and a passenger vehicle where the motorcyclist was killed occurred in intersections.
The National Safety Council reminds motorcyclists:
  • Avoid riding in poor weather
  • Wear bright colored protective gear
  • Wear a U.S. Department of Transportation approved helmet
  • Use turn signals for every turn or lane change
  • Be aware of other motorists blind spot.
Motorcyclists should not ride a motorcycle that is beyond their riding ability. In addition, motorcyclists should get special training. In Washington State, motorcyclists must get a motorcycle endorsement to ride on the highway.

For more motorcycle safety information, see the "Share the Road" web-site.

Teenage driving safety -- a book that might prevent car accidents

We came across a book that might be worthwhile reading to parents of teenagers who are embarking on their driving career. Entitled, Licensed to Drive! Using the Power of Story to Instill Wisdom and Safety in the Next Generation of Drivers by Lynn Bieber, MS MFT, the book teaches teen drivers by telling stories.

Car accident statistics are very worrying to most parents: In a given year, more than 4,000 teenage drivers are killed in car accidents and even more will have their lives altered because of serious injuries and disabilities such as traumatic brain injury, spinal cord injury and severe facial cuts and fractures.

The premise of this book is that teenagers can relate to a story better than a lecture. Written by a licensed Marriage Family Therapist the author raised four children and her youngest son was killed in a car accident. She writes from her wisdom and experience.

If you have a teenage driver, you might want to purchase this book. Click here for more information.

Driver was text messaging in trolley accident

Federal Investigators have ruled that the driver of a Boston trolley was at fault in a accident in which he rear-ended a stopped trolley because he was texting at the time of the trolley accident. The accident occurred on Friday night and injured 20 people.

According to CNN.com, trolley operators were already banned from using cell phones while driving but after the accident, they were told to leave mobile devices at home.

A train operator was text messaging in last year's devastating train accident in California in which 25 people were killed.

In Washington State, drivers are banned from text messaging while driving and also banned from using a cell phone without a hands-free device. Violators can receive a $101 ticket.

If you believe your car accident was caused by someone using a telephone, you may have case for the driver's negligence. Read "What if my accident was caused by someone using a cell phone?" for more information.

The teenager was driving on a an intermediate driver's license. In Washington State, teenagers are issued intermediate license which states if you commit 3 driving violations your license will be suspended until age 18. The teen already had a violation so he will probably lose his license.

Device that monitor teenage driving increases safety says study

We just read a report issued by the Insurance Institute for Highway Safety which studied how installation of monitoring devices improves driving in teenagers between 16 and 19 years of age. The study monitored devices which reported risky driving practices including:

teenage-driver.jpg

  • failure to use seat belts
  • sudden braking
  • sudden acceleration
  • speeding
The study sought to determine how monitoring teenage driving effected their driving. The device monitored instances of sudden braking, sudden acceleration, speeding and non use of seat belts. Data from a the device was then transmitted via a satellite to a central computer. Depending on the study group, some devices sounded an alert when they detected the unsafe behavior.

Seat belt use was already high among the teeen age drivers but improved significantly when seat belt violations were reported to the parent web-sites and improved even more when in-vehicle alerts sounded. Teenagers in the groups where parents were notified of unsafe behaviors or when an alert sounded also reduced sudden braking/accelerations.

The study concluded that electronic monitoring of teenage drivers reduced incidents of risky behaviors, especially seat belt non-use.

Read the complete study, "In-Vehicle Monitoring and the Driving Behavior of Teenagers."

After reading the article, we were wondering if insurance companies might reduce the rates of teenagers whose families install the device. Nevertheless, we are pleased that such a device may reduce the risk of car accidents which seriously injure and kill teens every year.
