ALERT Drivers bill introduced in U.S. Senate to ban texting while driving

The Alert Drivers Act -- "Avoiding Life-Endangering and Reckless Texting by Drivers Act" -- is a bill introduced by Senate Democrats which require all states to ban texting on cell phones or other personal electronic devices by drivers.

The bill applies to anyone operating a car, truck, bus or mass transit system conveyance like light rail. Already, 14 states have a ban in place and 11 states have a modified plan. Washington State recently enacted RCW 46.61.688 "Sending, Reading, or Writing a Text Message While Driving" which makes it a secondary offense to text while driving.

The Senate's bill, if passed, requires states to issue texting bans or lose federal highway funds.

A research report by Virginia Tech Transportation reported that drivers truck drivers who text while driver are 23.2 times as likely to be in an accident than non-distracted drivers. Likewise, a report in Car and Driver magazine revealed that texting while driving is even more dangerous than driving under the influence.

Drunk driver arrested after hit-and-run accident into Tacoma police car

The Tacoma News Tribune reports that a 21-year-old Puyallup man was arrested after he was involved in a hit-and-run motor vehicle accident with a Tacoma police car.

According to the report, the car accident occurred in the 1400 block of South 84th Street around midnight. The man hit a police car with its lights on and then the man drove away. Police were able to arrest the man because his car was damaged and he was unable to drive very far.

Police have arrested the man on charges of driving under the influence and hit-and-run. The police officer was treated for injuries and released.

Virginia Tech Transportation Institute releases study on cell phone and driver distraction

Virginia Tech Transportation Institute just released the data from their large-scale and naturalistic driving studies which provide data on driver distraction and cell phone usage. Their studies observed drivers for more than 6 million miles of driving.

We recommend you read the study and share it with the members of your family. Basically, the study tells us what we already know: using cell phones while driving distracts the driver -- even a hands-free device -- and increases your chances of being in a car or truck accident. Text messaging or "texting" while driving is even more dangerous than dialing or answering your phone. Truck drivers who text message are 23.2 times more likely to be in a truck accident or near accident while texting.

Tacoma considering expanding red light camera program to catch speeders and red light runners

The Tacoma City Council is considering the amendment of a city ordinance which would allow the city to install "red light" cameras at more intersections throughout the city reports The Tacoma Daily Index. Currently, the ordinance only allows the city to install them in school speed zones. The change in the ordinance would allow the city to install the cameras at problem intersections.

A class action lawsuit has been filed against 19 Washington Cities including Tacoma regarding excessive fines levied against motorists who have received red light tickets.

Anecdotal evidence shows that red light cameras have lowered motor vehicle accidents at intersections where they have been installed. At one Lacey intersection, car accidents have been reduced from 21 to 1 after a red light camera was installed.

Two Algona youths killed in single-car accident near Lake Tapps

The Tacoma News Tribune reports that Zachery Oliver, age 21, and Chase Tinsley, age 18, both of Algona died early Saturday morning in a single-car accident near Lake Tapps. Algona is a city south of Auburn and approximately 35 miles south of Seattle.

The report said that the car was found off the road in a shallow pond. Investigators believe the car was speeding when it hit a tree and flipped, killing both men.

Toxicology tests will be preformed to determine if alcohol or drugs were involved.

Insurance Institute compares 2-door cars with 4-door cars for safety in car accident tests

Automobile manufacturers keep making safety improvement to cars and that is a huge factor in the decrease in car accident fatalities per mile driven over the past five years. The Insurance Institute for Highway Safety usually does crash tests on 4-door car models because of the requirements for safety for family use cars. They decided to test five 2-door car models to see how they hold up in crash tests because not all the data from 4-door cars pertain to 2-door cars.

The IIHS tested four small cars and one mid-size car:

  • Chevrolet Cobalt
  • Ford Focus
  • Honda Civic
  • Scion tC
  • Volvo C30

Ratings

There are four ratings give for each crash test: Good, Acceptable, Marginal or Poor. Of the five cars that they tested, all received an Acceptable or better in the three types of crash tests. Of the cars tested, the Volvo and the Ford received the "Top Safety Pick" and all the other vehicles were rated Acceptable or better.

Frontal accident test

All five cars earned a Good in the frontal offset test. In 2007, here were 14,000 car accident fatalities due to frontal car accidents so this is a very important test.

Side impact accident test


Of the five cars tested, only the Ford and the Volvo received a Good rating while the other vehicles all received an Acceptable rating. Side impact car accidents are the second most common type of car accidents resulting in 8,000 people being killed in side impact car accidents in 2007.

The results of this test showed that the 4-door models do not always perform the same as the 2-door-models. The Honda Civic earned a Good when the 4-door model was tested and only an Acceptable with the 2-door model. The Ford Focus actually performed better on the side crash tests with the 2-door model than the 4-door model.

Rear end test

Whiplash injuries including neck sprain and strain are the number one car accident injury. Automakers have been working on the designs of seats and also the restraints to reduce whiplash injuries. In the rear end test, they test how the seats and restraints protect against injury in low-speed rear-end car accidents. They test a stationary vehicle being rear-ended by an SUV or pickup truck at 20mph.

In this test, all five of the cars tested were rated Good except the Scion tC which received an Acceptable rating.

Police looking for bus in Seattle hit-and-run pedestrian accident

A pedestrian was killed in an apparent hit-and-run accident in downtown Seattle on Cherry Street near Sixth Avenue late Friday night or in the early hours of Saturday morning. A passerby called 911 and reported a man lying the roadway around 12:22am reports The Seattle Times.

Police found the pedestrian, a man, dead in the street. He had apparently been run over by a large or heavy vehicle.

Police are looking for a bus, possibly a tour bus, of light-color with a dark stripe. This vehicle had been seen turning turned from sixth onto Cherry. They are asking anyone that may have information about the accident or the bus to call the Seattle Police Department or Crime Stoppers of Puget Sound at 800-222-TIPS.

By all accounts, the pedestrian was crossing at a legal intersection. Washington state laws give pedestrians the right of way and drivers of cars must stop to allow pedestrians and bicycles to cross the road within a marked or unmarked crosswalk. Many pedestrian accidents are caused by the negligence of the driver of the motor vehicle.

Two women seriously injured in violent Everett car accident

Seattle's King5.com reports that two women were critically injured in a two-car accident in the 8100 block of Evergreen Way at 79th Place on Thursday night around 10:30pm.

According to the report, the women were turning into the K-Mart parking lot when a Pontiac GTO crashed into their Ford Taurus, tearing it in half. The rear of the Taurus burst into flames after impact.

Everett Police Lieutenant Rod Sniffen reported that the two women had to be extricated from the Taurus using the Jaws of Life.

Police are investigating the cause of the car accident and whether alcohol or drugs was involved. It is probably safe to assume that the GTO was speeding because the results of the crash was so violent. The driver of the GTO and passenger did not appear to be injured.

A person who is involved in a car accident where someone is seriously injured or killed can be charged with Vehicular Assault if it is determined that they were driving with reckless disregard of the safety of others or driving under the influence.

Almost half of Seattle pedestrians do not feel safe in crosswalks

The Seattle Department of Transportation (SDOT) is working to improve the walking experience and pedestrian safety in Seattle. In a random survey of 702 Seattle residents, they found that:seattle pedestrian accident attorney

  • 4 out of 10 surveyed said they experienced a "near miss" or a car almost hit them
  • 70% of those surveyed said that car drive too fast on their streets
  • More than 50% said that they did not feel safe crossing intersections.
The SDOT said that they will use this survey to create a "master plan" that addresses pedestrian safety and reduces pedestrian accidents.

Washington State Patrol working to reduce car-commercial truck accidents

The Washington State Patrol is targeting drivers who drive unsafely around large commercial vehicles. Between 2005 and 2007, there were 5000 commercial truck accidents in Washington State. In analyzing the statistics, they show that the driver of the car was at-fault in two thirds of the accidents which resulted in 175 fatalities and 450 injuries. The Washington State Patrol is trying to enforce behavior changes among drivers including leaving more room for trucks, avoiding tailgating, reducing speeding around trucks and reducing aggressive driving.

During a two week period in Spokane and Grays Counties, State Patrol troopers are going to ride in the cabs of commercial trucks to help spot cars who follow too closely or cut the big trucks off reports Seattle's King 5.com.Chief John R. Batiste of the Washington State Patrol says:

Motorists who drive recklessly, or are unsafe around these big rigs, are asking for trouble. When a car and a commercial vehicle are involved in a collision, the car will lose.”
The patrol is working with a grant from the Federal Motor Carrier Safety Administration.

Man critically injured in Seattle bicycle accident near Seward Park

A 44-year old bicyclist suffered life-threatening injuries after he ran into the side of a van whose driver made a left turn in front of him reports Seattle's KOMO News.

The bicycle accident happened at the intersection of Lake Washington Boulevard South and South Orcas Street around 6:35pm Friday evening.

According to the report, a Chevy van driven by a 29-year-old driver was headed north on Lake Washington Boulevard South and made a left turn onto Orcas Street. The bicyclist, who was headed South on Lake Washington Boulevard, ran into the van. The bicyclist was taken to Harborview Medical Center in Seattle and was listed in critical condition.

Washington State statute
provides that a driver turning left within an intersection should yield the right-of-way to any vehicle approaching from the opposite direction. The right-of-way is not absolute but relative but the primary duty rests upon the driver who is turning to left to leave a fair margin of safety at all times.

Man involved in pedestrian accident near Northgate mall

A pedestrian, who darted into traffic near the Northgate mall, and was hit by a car was not seriously injured in the accident reports The Seattle Times.

The 31-year-old man was said to have been "possibly highly intoxicated" when he ran into traffic along Northgate Way, two blocks west of the Northgate mall. A 28-year-old woman driving a Chevrolet Cavalier hit the man who was thrown onto the car's windshield and hit his head when he fell to the pavement.

Initially, it was thought that the man had suffered life-threatening injuries. He was taken to Harborview Medical Center in Seattle and should be released after 24-48 hours.

Police may cite the man for jaywalking.

Washington actor James Caviezel injured in motorcycle accident near Leavenworth

Actor James Caviezel, who was born in Mount Vernon, suffered cuts and bruises when he was involved in a motorcycle accident 14 miles outside of Leavenworth, Washington according to The Seattle Times. Caviezel stared in the motion picture, "The Passion of the Christ."

Caviezel was riding a 2006 Harley-Davidson motorcycle when a Wenatchee man, who might suffer from mental illness, threw a bicycle in his path. Caviezel, who was wearing a helmet, was taken to Cascade Medical Center in Leavenworth for treatment.

Sultan man injured in motorcycle accident near Entiat

Colin M. Kenagy, age 41 of Sultan, was injured in a motorcycle accident near Entiat. Kenagy was taken to Central Washington Hospital in Wenatchee for treatment of injuries to his right arm and elbow.

According to a report in The Wenatchee World, Kenagy was driving north on Highway 97A when a Ford Escape driven by Lorilee A. Judy, age 46 of Olympia stopped for a deer crossing the road. Kenagy ran his 2004 Yamaha motorcycle into the rear-end of the Ford.

Judy was not injured injured in the accident.

Sammamish teen arrested for reckless driving for driving 93mph

The Snohomish Police arrested a 17-year-old Sammamish girl for driving 93 mph in a 45 mph zone. The girl was driving a 2007 BMW 328i at high speeds on Sahalee Way near the Sahalee Golf and Country Club around midnight..

According to the police, the girl was charged with reckless driving. Her excuse was that she was late for her curfew.

Seattle-area men injured in motorcycle accident on Highway 2 near Leavenworth

The Wenatchee World reports that Michael W. Sorensen , age 21 of SeaTac, and Joseph A.W. Sorensen, age 26 of Tukwila, both suffered injuries in a motorcycle accident on Highway 2 just west of Leavenworth on Sunday morning.

According to the report, the motorcycle accident occurred when a pickup truck, driven by Ramiro Botello-Botello, age 43 of Cashmere, stopped abruptly for backed up traffic. Michael Sorensen injured his knees when his 2007 Suzuki motorcycle hit the pickup. Joseph Sorensen suffered injuries to his right shoulder blade, knee and elbow when he swerved to avoid hitting the pickup and lost control of his 2008 Suzuki motorcycle. Both men were taken to Cascade Medical Center in Leavenworth for treatment.

Both Michael and Joseph Sorensen were cited for following too closely. Washington State Statutesays that the primary duty of avoiding a collision rests upon the following driver. The following driver should not follow another vehicle more closely than is reasonable and prudent and must regard speed and traffic on the road and maintain as much distance as required to make an emergency stop.

Two killed, three injured in Highway 3 car accident near Poulsbo

A Kent father of two, Michael B Kelly, age 50, was killed and his family suffered devastating injuries when the Jeep Grand Cherokee they were driving in was hit head-on by a Jeep Cherokee driven by an unidentified man on Highway 3 near Poulsbo reports The Seattle Times. The unidentified man was also killed in the car accident.

Kelly's wife suffered a serious spinal injury, his 11-year-old son is in critical condition with a skull fracture and a four-year-old daughter suffered serious injuries in the car accident. The family is being treated at Harrison Hospital in Bremerton.

The Kelly family was returning from a day-trip to Victoria, B.C. late Saturday evening and were driving south on Highway 3 when the accident occurred. Just south of the Hood Canal Bridge, a man driving a Jeep Cherokee north, crossed the center line and hit them head-on.

The cause of the car accident is being investigated.

Pair injured in roll-over car accident at Interstate 182

The Yakima Herald reports that George Gutierrez, age 32, and his passenger, Jildardo Ramirez, age 30 both of Prosser were injured in a roll-over car accident on State Route 240 at Interstate 182.

According to the report, the motor vehicle accident occurred on 11:40pm on Friday night as Gutierrez was traveling west on SR 240 and was merging onto I-182. He apparently drove his GMC Sierra pickup off the roadway and it rolled.

Gutierrez, who was wearing a seat belt, was treated and released. Ramirez was admitted to Kadlec Medical Center in Richland where he is listed in satisfactory condition.

Man critically injured after running into a tree on logging road near McCleary

Aberdeen's The Daily World reports that a 27-year-old McCleary man was critically injured in a truck accident and his companion, a 23-year-old McCleary man, suffered minor injuries when the Ford Ranger truck the man was driving hit a tree off of a gravel logging road near McCleary.

According to the report, the driver is suspected of driving under the influence at the time of the single car accident. In Washington State, a driver is deemed impaired if their blood alcohol content is .08% or greater.

Cross over car accidents still plague U.S. 2 between Monroe and Snohomish

There have been 51 fatal car accidents on U.S. Route 2 since 1999 and 19 of those fatalities have been due to cross over crashes reports The Everett Herald Net. This past week a small truck crossed over the center line and hit a Snohomish County sheriff's deputy patrol car, killing the truck driver and injuring the deputy and his passenger.

U.S. Route 2, also known as Stevens Pass Highway, is an important west-east link across the Cascade mountains. It travels from Everett, through Monroe, Sultan, Startup and Gold Bar before heading to Stevens Pass and Leavenworth.

The Washington State Legislature has allocated $10 million for safety improvements for U.S. 2. The work is scheduled for 2010 and will include new turn lanes and the closure of some intersections.

Governor Christine Gregoire designated US 2 as a "traffic safety corridor" which provided low-cost and short-term solutions to address the problem of fatal and disabling car accidents. Highway improvements already in place are 40 miles of rumble streets along the center line and shoulders between Monroe and Stevens pass. The rumble strips seem to have reduce car accidents.

Many people who live along Highway 2 and the people who travel it complain that the improvements to the highway are not coming fast enough. Most people believe the highway needs to be widened and anything less than that is a stop-gap measure.

The US 2 Safety coalition is working to raise awareness of the hazards on US 2 and working to solve the problems of gridlock, especially during holidays and weekend.

One killed, deputy and passenger injured in SR2 head-on car accident near Monroe

A man was killed in a car accident on State Route 2 west of Monroe after he drove his small pick up truck across the center line and head-on into a Snohomish County Sherriff's office patrol car around 4am. The small pick up truck caught on fire and the driver was pronounced dead at the scene according to The Everett Herald Net.

Injured in the auto accident was a 35-year-old sheriff deputy and his passenger, a man he was taking to Snohomish County Jail to book on a charge of domestic violence. The fire department had to cut the top off the patrol car to extricate the sheriff deputy and his passenger.

The deputy was taken to Harborview Medical Center in Seattle for treatment and his injuries were thought to be "non-life-threatening." The passenger was taken to an area hospital were he was expected to be released after a night in the hospital.

US 2 has been designated a "safety corridor" because the high number of serious and fatal car accidents on the road. The US 2 safety corridor sign that keeps track of the days since the last accident had to be reset after two days. The US 2 Safety Coalition was formed by people who are committed to widening the road and making safety improvements to the road.

King County had 45% fewer car accidents over July 4th weekend

King County had a drop in the number of car accidents over the July 4th weekend reports the Washington State Patrol.

The Patrol, who launched a DUI and aggressive driver emphasis patrols in strategic areas in western Washington reported that there were no serious injuries and no fatal auto accidents in King County. The patrol arrested 51 driving under the influence drivers and responded to 26 automobile accidents, with eight of those injury accidents.

Washington State Patrol targets unsafe driving around commercial trucks

The Washington State Patrol is targeting drivers of cars who drive unsafely around large commercial trucks. The Patrol reports that, in Washington, between 2005 and 2007 there were almost 5000 commercial truck accidents. Statistics show that the car driver was at-fault in two-thirds of the accidents resulting in 175 fatalities and 450 injuries. The Patrol says that drivers need to leave space for trucks and learn ways to share the road.

Chief John R. Batiste of the Washington State Patrol says:

Motorists who drive recklessly, or are unsafe around these big rigs, are asking for trouble. When a car and a commercial vehicle are involved in a collision, the car will lose.”
Given these statistics, the Patrol has a worked with other law enforcement agencies to create the Ticketing Aggressive Cars and Truck (TACT) project. The patrol, in an effort to reduce accidents, are trying increase the public's awareness of unsafe driving behaviors around commercial vehicles.   • cutting off trucks
  • tailgating
  • failure to yield the right of way
  • speeding
  • aggressive driving
The Patrol launches the TACT enforcement periods from July 13-24 and September 14-25, 2009. They are targeting routes in Western Washington along State Route 8 and State Route 12. In Eastern Washington, along State Route 2.

The TACT project is a grant from the Federal Motor Carrier Safety Administration.

Washington woman killed in Colorado car accident that killed four

A Washington woman was killed in a Colorado car accident that killed four and injured two others reports The Denver Post.

The Washington woman was driving a minivan with a male passenger, also from Washington State, and a woman from Oklahoma. The female passenger was also killed.

The fatal car accident occurred on U.S. 287 near Wiley in southeastern Colorado when a car driven by a teenager crossed the center line and hit the Washington woman's Nissan minivan head-on. Police do not believe alcohol or drugs were involved.

The Washington state man was seriously injured and was airlifted to Memorial Hospital in Colorado Springs. Police are withholding the names of the dead and injured until the victims' families have been notified.

Police looking for GM Astro van in Lake Stevens hit-and-run pedestrian accident

The Washington State Patrol are looking for a 1995 GMC Astro van because they believe it was driven by the person responsible in the hit-and-run pedestrian accident that killed Heather Trickler near Everett in May. The Patrol is asking anyone with knowledge of the van to call them at 360-658-2588.

According to a report in The Seattle Times, General Motors assisted the Patrol in identifying the vehicle that struck and killed Heather. General Motors studied photos of the accident scene and were able to identify the vehicle. Investigators say the van had a broken headlight, and was missing the antenna and the passenger side mirror after the accident.

Heather Trickler was 15 years old when she was struck while walking east on the shoulder of Highway 2 near Homes Acres Road around 10:15pm on May 30. Whoever hit her, left the accident scene and her body was not discovered until the following day.

Man dies after Bremerton bicycle accident

Seattle's King5.com reports that James McClurkan, age 69, died at Tacoma General Hospital on Sunday after being hit by an SUV driven by a local woman while bicycling in Bremerton on Saturday around 1pm.

According to the report, McClurkan, who was wearing a bicycle helmet, was hit by a Nissan Murano SUV near Wildcat Lake. The impact of the collision caused McClurkan to hit the SUV's hood and windshield and then roll off into a drainage ditch.

Police are investigating the cause of the bicycle accident but they don't believe alcohol or speed were the cause.

Spokane woman seriously injured in pedestrian crosswalk accident

The Spokesman Review reports that a woman suffered a traumatic head injury in a pedestrian accident after being hit by a truck in a downtown Spokane crosswalk early Thursday morning.

The pedestrian accident occurred at the crosswalk on Post Street and First Avenue. The driver of a Chevy pickup was turning left and failed to yield to the woman who had the Walk sign.washington pedestrian accident
The driver may be charged with failure to yield to a pedestrian but police said their was no sign that alcohol or drugs were involved.

Every year approximately 100,000 pedestrian are injured by motor vehicles. Washington State laws provides that pedestrians have the right of way and drivers must yield. Failure to do so is negligence on the part of the motorist.

Seattle bicyclist killed after being hit by car on Highway 99

Seattle's KOMO News.com reports that John U. Leoni, age 35, of Seattle was killed on Wednesday night in a bicycle accident on Highway 99 in Seattle.

According to the report, the Leoni collided with a car, a Porsche, a little after 10pm in the southbound lanes near the Dexter Avenue exit. The driver of the car, is suspected of driving under the influence at the time of the accident. The driver was taken to the hospital with injuries.

If the driver is determined to be under the influence of alcohol or drugs at the time of the accident, he or she could be charged with Vehicular Homicide, RCW 46.61.520. This Washington State statute provides what if a person succumbs to injuries as a result of negligent operation of a motor vehicle, the driver can be charged.

In addition, the family of the person killed as a result of Vehicular Homicide, can bring a suit for wrongful death.
