Man killed, son critically injured in Snohomish County head-on car accident near Oso

An Arlington-area man was critically injured and his father was killed when the car they were driving near Oso in Snohomish County crossed the centerline and into the path of an oncoming dump truck.

Thomas Wheeler, age 27, was driving the Buick Skylark east on Highway 30 near Oso around 5:15am when he crossed the double line. He suffered "life-threatening injuries" including burns and a severe leg injury. He was taken to Harborview Medical Center in Seattle for treatment. Officers speculate that Wheeler may have fallen asleep at the wheel due to the early morning hour and the lack of skid marks made by the Buick.

Killed in the car accident was Wheeler's father, Keith Wheeler, age 49. He had been sitting in the passenger seat when the car accident occurred.

The dump truck driver was John Meyers, age 42, of Darrington. Meyers applied the brakes but he could not avoid the Buick. There was no mention in The Seattle Times whether Meyers was injured.

New York state joins Washington and 16 other states in banning text messaging while driving

The Insurance Institute for Highway Safety has announced that New York has joined Washington state in banning text messaging by all drivers. The New York law is effective November 1, 2009.

About half of the states still have no cell phone bans while eight states have only partial bans. Click here for a list of cell phone laws by state.

Washington State has banned all drivers from using a hand-held cell phone and text messaging while driving. The states with cell phone bans vary in their approach. Some states only place the ban on drivers younger than 18 and school bus drivers.

Washington state cell phone laws apply to all drivers but the offense is categorized as "secondary." That means that a driver will not be ticketed unless he or she is stopped for another offense like speeding, illegal lane change or running a stop light.

Hot Wheels reports lists most stolen cars in Washington State

The National Insurance Crime Bureau (NICB) just issued their annual Hot Wheels report which lists the top 10 most stolen cars in Washington state for 2008. The NICB is a not-for-profit organization which is dedicated to fighting insurance fraud and vehicle theft.

According to the NICB, older cars tend to be the most stolen because thieves have a market for used auto parts.

The top 10 stolen vehicles for Washington state are:

  1. 1992 Honda Accord
  2. 1995 Honda Civic
  3. 1989 Toyota Camry
  4. 1994 Acura Integra
  5. 1993 Saturn SL
  6. 1994 Nissan Sentra
  7. 1988 Toyota Pickup
  8. 1995 Nissan Pathfinder
  9. 1993 Subaru Legacy
  10. 1994 Jeep Cherokee/Grand Cherokee

The NISCB suggests a "layered approach" to protecting your vehicle and preventing car theft. These common sense solutions include:seattle personal injury attorney

  • Locks & Keys -- Always lock your car.
  • Alarms - Install a car alarm which issues an audible warning.
  • Immobilizing Device - Use smart keys, "kill switches", fuel cut-offs and other devices which prevent your car from being started are highly effective.
  • Tracking Device - Install GPS systems which track a stolen vehicle help police recover a stolen vehicle. Vehicles with a tracking system are often recovered faster and with less damage.
The NICB also recommends checking a vehicles VIN before purchasing a used automobile.

The NW Insurance Council reports that several cities in Washington state rank high in the nation for car thefts. Yakima was listed as the third-highest auto theft rate in the nation. The Seattle-Tacoma-Bellevue metroplitan area ranked 25th in the nation for auto theft.

Man killed, 2 injured in Everett car accident

Police believe that speed may have been a factor in the car accident death of a 20-year-old man who was killed as he made a left turn on Friday evening in Everett.

Seattle's KOMO News.com reports that the man was driving southbound on Everett's Evergreen Way and was attempting to make a left turn into a parking lot in the 9000 block. According to the report, a Northbound Acura t-boned the man's Toyota and he was killed at the scene.

The driver of the Acura and his female passenger were taken to Providence Hospital in Everett with non-life-threatening injuries.

Report says drunk driving is on the rise among women, declining in men

In last week's news, we heard about the New York mother, Diane Schuler, who was responsible for a deadly fiery wrong-way car accident that killed herself and four children in her car and three men traveling in another vehicle. When the toxicology reports came out, Schuler's blood alcohol level was 0.19 percent, nearly two times the legal limit for drivers.

A recent report by the AP says that federal studies show that the abuse of alcohol has been increasing among women. And, while driving under the influence (DUI) arrests has decreased over the past ten years for men, it has increased in women. In fact, FBI statistics show that driving under the influence arrests among women was increased by almost 30% in women when comparing 1998 with 2008.

These statistics are especially chilling when you think that drunk drivers often have their children in the car with them. Says the director of Mothers Against Drunk Driving, Chuck Hurley, "It's the ultimate form of child abuse."

Washington car accident fatalities at worst last weekend

The Washington State Patrol reported that last weekend, July 31st - August 2, was the worst of the year for car accident fatalities. Across Washington State, there were six major car accidents and 10 people were killed. The fatal car accidents occurred in Yakima, Thurston, Lincoln and Snohomish counties.

The Patrol emphasizes that the car accident deaths were largely the fault of drivers making bad decisions. Of the six car accidents:seattle car accident attorney

  • Three of the 10 people killed were not wearing seat belts.
  • In three of the six accidents, alcohol was involved.
  • In all of the accidents, speeding, aggressive driving and driver inattention were factors.

Of the six car accidents, three were single-car accidents, two were two-car accidents and one accident involved four cars.

The Patrol would like drivers to look at these deaths as a warning to make good choices and decisions before they drive. Studies show that wearing seat belts and reducing speed prevents car accident fatalities and using alcohol or drugs puts everyone at risk.

Woman injured in Lynnwood pedestrian accident

A 50-year-old Lynnwood woman was injured in a pedestrian accident on Highway 99 on Wednesday night around 7pm.

1 teen killed, 1 seriously injured in Olympia DUI car accident

The teenage driver of a Chervolet Blazer has been arrested after a roll-over single-car accident in Olympia killed one of his passengers and seriously injured another reports The Olympian. The car accident occurred around 12:30am on Mountain Air Drive in Olympia when the driver, Emil R. Swartling, age 18, lost control of the vehicle and hit a retaining wall causing the SUV to roll. Police believe alcohol and speed were factors in the accident.

The report said that the front seat passenger Silas B. Turner, age 18, was killed at the accident scene. The rear seat passenger, Terrence Florence, age 18 of Lacey, suffered serious injuries and was taken to a hospital.

Swartling was arrested on suspicion of driving under the influence. He may be charged with Vehicular Assault and Vehicular Homicide. Vehicular Homicide can be charged if someone is killed in a car accident and the driver was under the influence at the time of the accident or driving with reckless disregard to safety. Vehicular Assault can be charged if someone is seriously injured.

The comments on The Olympian blog make some very valid points. How did these teenagers procure alcohol? One blogger wrote, "Who handed them the loaded gun [alcohol]?"

In Washington State, the blood alcohol content (BAC) intoxication standard is 0.08%. A personal injury law firm that is experienced in representing the victims of drunken drivers will also investigate if a restaurant, bar or person supplied alcohol to underage persons and thus be liable for damages.

Oregon joins Washington and other states in passing cell phone ban law

Oregon has just passed a law banning the use of hand-held cell phones while driving. The new law, which goes into effect January 1, 2010, pertains to all drivers. Unlike the Washington State cell phone law which made using a hand-held cell phone a secondary offense, Oregon went a step further and made it a primary offense. A secondary offense means that a police officer cannot stop a driver if he or she sees a driver using a hand-held cell phone unless they are pulling them over for a primary offense like running a red light or speeding.

Oregon's Cell phone law is House Bill 2377 and it imposes a $90 fine for a violation. In addition, it prohibits drivers younger than 18 from even using a hands-free cell phone but allows adults to.

Recent car accident data shows a correlation between texting and using cell phones while driving with an increased car accident risk. If you believe your car accident was caused by someone using a cell phone, read What if my accident was caused by someone using a cell phone?
