Department of Transportation applies ban to texting by commercial truck and bus drivers

The Department of Transportation is getting tough with professional drivers who text message while driving, prohibiting all truck and bus drivers from sending text messages -- texting -- while driving a commercial vehicle.

The penalty for texting includes civil or criminal penalties and fines up to $2,750 says the DOT.
seattle car accident attorneyFederal Motor Carrier Safety Administration Research shows that drivers who text message take their eyes off of the road from between 4-6 seconds while texting. If the driver is moving at speeds of 55 miles an hour, they will have driven the length of a football field before their eyes look at the road.

A Vancouver, Washington man was just sentenced to 5 years in prison for Vehicular Homicide after a fatal car accident attributed to the fact that he was texting while driving. Antonio Cellestine hit and killed a bicyclist, Gordon Patterson, who was riding his bicycle at the time. Cell phone records show that Cellestine had been texting prior and during the accident.

The message is getting out to all drivers: no texting while driving!

Light-rail vs. car accident in Rainier Beach area of Seattle

A car was hit by the Sound Transit light-rail train in the Rainer Beach area of Seattle on Sunday reports The Seattle Times. No injuries were reported.

According to the report, the motor vehicle accident occurred a little before 6pm when the car turned left in front of the train.

The Sound Transit light-rail service began in July and this is the fourth accident involving a car. Anecdotal evidence in other cities suggests that collisions between the light-train and cars lessens after drivers of automobiles become accustomed to the trains.

Vancouver man sentenced to 5 years for fatal car accident attributed to texting

The Seattle Times reports that Antonio Cellestine of Vancouver has been sentenced to 60 months in prison for Vehicular Homicide after he hit a bicyclist who was riding home from work.

Cellestine was text messaging his girlfriend when his car veered into the bicycle lane and he hit and killed Gordon Patterson a 50-year-old high school teacher in September of 2009. Records from Cellestine's cell phone proved that he was text messaging using his cell phone prior to and during the car accident.

A person can be convicted for Vehicular Homicide if a person was killed and the driver was driving under the influence of alcohol or drugs or driving with reckless disregard to the safety of others.

Cellestine's conviction is thought to be the first Vehicular Homicide conviction due to text messaging in Washington. This conviction comes at a time when the state legislature is considering making texting and using a hand-held cell phone in the state a primary offense.

2-year-old girl shot in Tacoma 'road rage' incident

A 2-year-old Lakewood girl is recovering from her injuries after being shot in what police are calling an incident of 'road rage' in Tacoma on Sunday afternoon. The shooting occurred on the girl's second birthday.

According to a report in Tacoma's The News Tribune, a traffic incident occurred around 82nd Street and McKinley Avenue East around 2pm. The girl's father apparently thought a vehicle had "cut him off" so he cut the other vehicle off. That is when the driver of the second vehicle shot at the sedan the girl was riding in and she was hit.

Road rage is when a driver or passenger attempts to intimidate, injure or kill a driver or passenger in another vehicle on the road. Most road rage cases occur because of drivers cutting each other off, because of lane changes, parking spot disputes or gestures. Males are the perpetrators in most cases of road rage. In this case, police are looking for a Pacific Islander male, possibly Samoan, driving a black Ford Explorer.

Two young boys killed in Tacoma car accident

Two young brothers have died of injuries sustained in a Saturday night car accident along the Bay Street curve in Tacoma. The Bay Street curve is an area where Tacoma police have installed speed cameras in order to slow down traffic. Jordan Davis age 11 died a short time after the car accident and his brother, Jared Davis, age 8, died Sunday evening after he underwent surgery for his injuries.

According to a report written by Stacey Mulick in Tacoma's The News Tribune, the car accident occurred around 10:35 after the mother, a 41-year-old Bonney Lake woman, and her two sons left the Monster Truck Show held at the Tacoma Dome. The woman lost control of the car along the curve and went over the concrete lane divider and into oncoming traffic. Her car was hit by a small SUV on the passenger side.

The Tacoma Police department is investigating the mother for Vehicular Homicide as they believe alcohol and speed may have contributed to the accident. Can you get a whiplash injury in a low speed car accident?

We often get asked the question whether it is possible for someone to get a whiplash injury in a low speed car accident. Some times insurance companies balk at paying out on an insurance claim for a whiplash injury when the car accident was described as a fender bender, there were no skid marks or the damage to the vehicles involved is not that substantial. However, one cannot equate the damage to a motor vehicle to a person. Indeed people can and do suffer whiplash injuries which require treatment in low speed car accidents.
seattle whiplash injury attorney
One study published on the National Institute of Health web-site showed that biodynamic stresses which cause slight to moderate vehicle damage may be high enough to cause injuries. Low speed car accidents of just a few miles per hour can be severe enough to cause hyperflexion of the cervical spine and even accidents involving bumper cars at an amusement park have been known to cause whiplash injury.

One should never let an insurance company say that a person is not injured by looking at the physical evidence on a vehicle. A diagnosis by a qualified physician based on standards of orthopedic neurological testing should be sufficient.

Are marked crosswalks safer for pedestrians than unmarked crosswalks?

We've been reading Malcolm Gladwell's book of essays entitled What the Dog Saw. In the book, Gladwell discusses how people handle risk. Gladwell cites psychologist Gerald Wilde who says that human beings have a tendency to "compensate for lower risks in one area by taking greater risks in another." Wilde's hypothesis is called risk homeostasis.
seattle pedestrian accident attorney
Gladwell asks the question, "Why are more pedestrians killed when crossing the street at marked crosswalks than at unmarked crosswalks?" His answer is, because pedestrians feel that a crosswalk is a "safe environment," they take more risk and are less watchful for oncoming traffic or cross when the light is changing.

Something to think about.

Software solution to block text messaging while driving

We just came across some software that parents can purchase on a subscription basis which blocks text messaging while driving. Parents can install the software -- txtBlocker -- and set it to establish areas where their teens are not allowed to use cell phones and it blocks the sending and receiving of text messages while driving to prevent car accidents.
seattle car accident attorney
According to the National Highway Traffic Safety Administration, distracted driving is a factor in up to 80% of all car accidents. One statistic says that almost 50% of teenage drivers admit to text messaging while driving. This past week in Bellingham, a pedestrian was hit and killed and the teenage driver admitted that he was text messaging at the time of the accident.

The txtBlocker software also lets parents know where their teens were driving and, with Speed Alerts, lets parents know if their teen was traveling at an excessive speed.

Texting while driving has become a serious health and safety issue and many believe it is akin to drinking and driving in its danger.

Bellevue installs red light cameras at two intersections along 148th Ave NE

The Bellevue Reporter reports that the city of Bellevue has installed red light cameras at two intersections on 148th Ave NE including at the intersections of Main Street and Bel-Red Road.

The city of Bellevue will issue warnings to offenders until February 2nd and after that, tickets will be issued which will cost motorists $124. The tickets do not count as a moving violation.

Late last year, Bellevue installed speed cameras near Stevenson and Lake Hills Elementary schools. Since installing those cameras, they have seen the number of citations drop for each month. In October, they issued 1,088 citation and in December the number dropped to 732. The police department believes that this is proof that the cameras help modify driver behavior.

Red light and speed cameras have been a contentious issues; A class-action lawsuit against 22 cities -- including Bellevue -- and camera manufacturers will be heard by U.S. District Court this month.

All four people were injured when the sedan they were riding in collided with two vans in an "uncontrolled intersection" at 20th and Main street reports The Seattle Times.
