Honda and Acura vehicles to have new braking safety feature

Honda Motor Co. says that it will install a new safety feature on all Honda brand and Acura brand vehicles. The new feature is a brake override safety system which will cut power to the engine , preventing runaway car accidents.

According to Honda, all Honda and Acura passenger vehicles will have the new technology installed by the end of 2011. The new system cuts engine power when both the brake and accelerator are pressed at the same time.

This safety feature is being installed after approximately 6,200 complaints involving sudden acceleration -- including 89 deaths and 57 injuries -- were attributed to some Toyota Motor Corp. vehicles. In March, Honda recalled approximately 400,000 vehicles in the U.S. because of "soft brakes."

Keeping kids safe in the summer

Summer is supposed to be fun for kids but summer is the time when emergency rooms see more accidental deaths in children including drowning, heat related injuries and sun burns.

The following are some things to think about in the summer to avoid tragic accidents:
seattle wrongful death attorney
Swimming Pool Accidents
- Many people think that pool parties are safe because there are many adults around. The truth of the matter is that adults can be very preoccupied at parties. At parties, a safety monitor should be designated who's job is to be "life guard" at the pool. Another safety measure is to move excess pool toys and inflatables out of the water so that they do not block the view.

Floaties and life vests in swimming pools -- These devices often give a false sense of security and can slip off or not keep a child's head out of the water. Adult supervision is still required.

Drowning -- A child can drown is a matter of a minute or two. Drowning is the second leading cause of accidental death in children between 1 and 14.

Sunburns - Many people have the misconception that you cannot get a burn on a cloudy day. However, on on cloudy days UV exposure can be very harmful and sunscreen, hats and protective clothing should be used.

Heat stroke -- heat stroke and exhaustion can happen early in the season before the high temperatures of mid-July and August because many people haven't become acclimatized to the temperature.

Car Temperature - The inside temperature of a car can quickly rise to more than 170 when the outside temperature is between 80 to 100 degrees. Children can suffer brain damage or heat stroke at these high temperatures so never leave a child in a car alone.

Children left in cars -- Every year, between 15 and 25 children are accidentally left in the back seat of their parents or caregivers cars and die due to heat. We did not see these types of accidents before child seats were moved to the back. Visual clues or seat monitors should be used to avoid this type of tragic accident.

If this is the case, she could be charged with Vehicular Assault.

Tacoma man charged with DUI and vehicular homicide in MVA accident that killed Shoreline man

The Seattle Post-Intelligencer reports that Richard J. Hohn, 26, of Tacoma, has been arrested and may be charged with DUI, Vehicular Homicide and illegal lane change in the motorcycle accident death of Ernest E. Geer, 33, of Shoreline on Saturday.

According to the report, Hohn was driving his Toyota 4Runner northbound on Highway 7 around 3:40pm when he attempted a passing maneuver on a curving stretch of the two-lane highway. He struck Geer who was thrown off his motorcycle and was then hit by another vehicle.

Police believe that Hohn may have been under the influence of alcohol at the time of the accident. Washington state motor vehicle code, RCW 46.61.520 "Vehicular Homicide," says that a driver can be charged with Vehicular Homicide if a person is killed in an accident and the driver was driving under the influence of alcohol or drugs, driving with reckless disregard to the safety of others or driving recklessly.

When a driver is charged with Vehicular Homicide, he or she is tried by the State of Washington. In addition, the family of a person killed as a result of Vehicular Homicide can bring a suit for wrongful death.  The Washington state wrongful death statute allows the family of a person who was wrongfully killed to recover damages in a civil action on behalf of their deceased loved one.

Washington Patrol says "Secure your Load" to prevent accidents

The Washington State Patrol, in a media release, reminds motorists to properly secure loads on vehicles or risk a fine of $5,000 and a year in jail time.

Washington State Vehicle Code RCW 46.61.655:

No vehicle shall be driven or moved on any public highway unless such vehicle is so constructed or loaded as to prevent any of its load from dropping, sifting, leaking, or otherwise escaping there from.
Every year in the state of Washington, nearly 12 million pounds of refuse lands on county, state and interstate roads. This refuse is an eyesore, harms our wildlife and can cause traffic accidents. Every year, more than 400 motor vehicle accidents are caused by unsecured loads some resulting in devastating injuries and occasionally death.

Motorists often have the mistaken belief that if they carry something heavy in a pickup truck or trailer, they don't need to tie it down. While a couch, refrigerator or household furniture might not blow out of the back of a truck, the momentum of heavy objects when a vehicle stops can have disastrous consequences.

The Washington State Patrol tells witnesses to lost loads to call 911 immediately and provide the following information:

  • location where you saw the vehicle
  • direction in which the vehicle was traveling
  • the road the vehicle was traveling on
  • description of the vehicle including color
  • vehicle license plate number
  • name of trucking company or other identifying information on the vehicle
  • a description of what you saw
  • identify yourself as a witness or a victim.
Besides calling 911 regarding a lost load, you can report the incident on the WSP web site.

8 children and teenagers injured in Highway 97 rollover car accident

Eight children from Brewster were injured on Saturday night in a two-car accident when a car driven by Adriana Gomez Saucedo, 18, attempted to pass a GMC Yukon driven by Maria Zaudio Orozco, 49, and the two vehicles collided.

The motor vehicle accident occurred while both vehicles were traveling northbound on Highway 97, approximately 10 miles north of Brewster. Gomez Saucedo hit the GMC driven by Zaudio Orozco while attempting to pass; both vehicles left the roadway and Gomez Saucedo's car rolled at least twice.

According to a report in The Wenatchee World, four teenagers in Gomez Saucedo's Mazda were injured including  Cynthia Ramirez Arellano, 16, head injury; Edith Saucedo Gomez, 17, back and pelvis injury; Bernice Gomez Saucedo, 14, head injury; Carina Valasquez, 16, arm and head injury. Adriana Gomez Saucedo was not injured.

The four children injured in Zaudio Orozco's vehicle included  Laura Zamudio, 17, neck and head injury; Cynthia Ramirez, 16, neck injury; Esteban Orozco, 1, neck injury; Olga Orozco, 5, neck injury. Zaudio Orozco and Armando Zamudio, 42, a passenger, were not injured.

All eight victims were taken to Okanogan Douglas Hospital in Brewster for treatment.

Passing accidents can cause severe injuries and often involve fatalities. This is because the vehicles involved are usually traveling at speeds of 25mph or more and often involved head-on collisions. Passing maneuvers can be especially dangerous for new or inexperienced drivers.

WSP starts enforcing new cell phone law on June 10; no grace period

The Washington State Patrol is warning drivers that they will fully enforce the new primary cell phone law starting June 10. In a media release, the WSP says they will not offer a grace period and they will ticket drivers they see texting while driving or failing to use a hands-free device.

Bothell man killed in State Route 2 crossover car accident near Monroe

A 38-year-old Bothell man was critically injured in a car accident Saturday afternoon when the car he was driving crossed the center-line on U.S. Route 2 and hit an empty tanker truck. The unidentified man died of his injuries on route to Harborview Medical Center in Seattle.

According to a report in The Seattle Times, the motor vehicle accident occurred on around 12:15pm near Monroe.

The 50-year-old tanker truck driver from Anacortes was uninjured in the accident. One report said that two other vehicles were hit by flying debris.

There are many concerns about the safety of U.S. 2 between Monroe and the Cascades. This route is a vital link between eastern Washington and the Ports of Seattle and Tacoma and is considered the "gateway" to the Cascades ferrying outdoor enthusiasts and freight.

In 1997, the US 2 Safety Coalition was formed because of the number of fatal car accidents in eastern Snohomish County on this highway. In about a 10 year period, there have been more than 50 fatal motor vehicle accidents on the highway between Snohomish and Stevens pass and more than 20 of these have been "cross-over" accidents in which a driver crossed the center line. Many people, including the Safety Coalition, have lobbied the state legislature to allocate funds to improve the safety of the highway including putting in barriers or creating a divided highway. Many people believe that congestion relief on Highway 2 and safety concerns are ignored in favor of road improvements in more populous areas.

Truck driver was using cell phone and speeding in accident that killed 11

The Seattle Times reports that Kenneth Laymon, 45, was using his cell phone to send and receive calls right before the accident in Alabama on March 26 that killed Laymon and 10 members of a Mennonite sect that were traveling together to attend a wedding.

According to the report, Laymon was also driving more than 70 mph when he lost control of his tractor-trailer rig, crossed the center line and hit a van carrying the 10 people he killed.

Studies show that when a driver looks at a cell phone or map while driving, they are taking their eyes off of the forward roadway for 4-5 seconds. When driving at speeds of 70mph or more, the vehicle can travel a considerable distance in those 4-5 seconds, thus greatly increasing the chances of an accident like this. It is critically important that motorists keep their eyes on the forward roadway for everyone's safety.

Washington interlock device allows drivers with DUI license suspension to drive

Today, The Tacoma News Tribune and The Olympian both reported that Washington State Superintendent of public instruction, Randy Dorn, is legally allowed to drive even though he recently pleaded guilty to driving under the influence and received a 90-day driver's license suspension.

This may surprise some, but Washington State has an Ignition Interlock Driver License which allows some drivers to drive vehicles that are equipped with an ignition interlock device while their regular driver's license is suspended for alcohol-related DUI.

The ignition interlock device requires the driver to blow into the device and the vehicle will not start if the device detects alcohol on the driver's breath. The device may also require additional "Rolling retests" while the vehicle is being driven according to the Department of Licensing web-site.

The cost of installing and leasing an ignition interlock device is the responsibility of the driver. For more information about the Law, see the DOL web-site.
