91-year-old Seattle woman killed in pedestrian accident

The Seattle Times reports that a 91-year-old Seattle woman was fatally injured in a pedestrian accident while she was walking on a sidewalk in the Capitol Hill neighborhood of Seattle.

According to the report, the woman was struck by a pickup truck driven by a 34-year-old man who was backing up into a parking space. The woman was taken to Harborview Medical Center where she died of her injuries.

The pedestrian accident occurred at Harvard Avenue East and East Thomas Street.

The driver of the pickup truck was arrested and may be face charges; Vehicular Homicide may be charged if a person dies of injuries sustained in a motor vehicle accident and the driver was driving recklessly, driving with reckless disregard to the safety of others or driving under the influence of alcohol or drugs.

In additional to criminal charges, the family of the deceased may file a civil suit against the negligent party under Washingon State’s wrongful death statute.
