2-car accident on Highway 101 injures 5, 1 critically

October 30, 2010 by The Farber Law Group

The Washington State Patrol is investigating a Cosmopolis 2-car accident which injured five people under the age of 23 on Highway 101 three miles south of Cosmopolis on Friday night reports KOMO News.com of Seattle. Cosmopolis is a city in Grays Harbor County of around 1,500 people.

The Grays Harbor County car accident occurred around 11:45 when a 20-year-old Montesano woman lost control of the 2007 Toyota Scion she was driving and swerved her car into the path of a Honda driven by a 22-year-old Aberdeen man.

Police believe the driver of the Scion was speeding at the time of the accident and police are investigating her for DUI. She was uninjured in the accident but her passenger -- a 22-year-old Aberdeen man -- suffered a head injury and tailbone injuries.

The driver of the Honda was not injured but all four of his passengers were injured. A 20-year-old man suffered internal injuries and he was airlifted to Harborview Medical Center in Seattle. A 21-year-old man was taken to Grays Harbor Community Hospital after suffering a scalp laceration and jaw injury. A 17-year-old girl and a 20-year-old man were also taken to Grays Harbor with possible internal injuries. Another 17-year-old girl was taken to Grays Harbor with undisclosed injuries.

If it is determined that the driver of the Toyota was driving under the influence of alcohol or drugs, she faces charges of Vehicular Assault. Washington State Vehicle Code RCW 46.61.522 states that Vehicular Assault can be charged if a person is seriously injured in a motor vehicle accident and the driver was driving under the influence.

In addition to criminal charges, civil claims could be filed against the driver of the Toyota and her insurance company for damages received by the injured parties.

Apparently, one passenger in the Honda was not wearing a seat belt. Washington's seat belt law requires that everyone riding in a car be properly seat belted. Passengers that are 16 year of age are older, however, are responsible for themselves and could be cited.

Bonney Lake high school student suffers minor injuries in pedestrian accident

October 28, 2010 by The Farber Law Group

The Bonney Lake & Sumner Courier-Herald reports that a male high school student suffered minor injuries in a Bonney Lake pedestrian accident.

According to the report, the student was in a crosswalk at 199th Avenue East at 104 Street when a car driven by a female high school student hit him. The driver was traveling at a slow speed and she applied her brakes so the force of the impact was not bad. The pedestrian suffered minor injuries.

The weather conditions were described as "dark, rainy and windy with poor visibility."

The driver was cited for failure to yield to a pedestrian in a crosswalk. Washington State vehicle code RCW 46.61.235 states that a driver shall stop and remain stopped to allow a pedestrian or bicycle to cross the roadway within an unmarked or marked crosswalk.

Daylight saving time ends on November 7, 2010 at 2:00am which should improve the visibility of students walking to school. Until then, both pedestrians and drivers should pay close attention in the early morning hours since fall mornings are dark in the Northwest.

Pedestrian accident fatalities
have been decreasing over the past few years. In 2008, there were 4,378 people killed in pedestrian accidents. Nearly 20% of pedestrian deaths in 2008 were hit-and-run accidents.

October 27, 2010 by The Farber Law Group

A 39-year-old Lacey woman was killed when the car she was riding in slammed into the back of a Shelton School District bus around 6:30 this morning, south of Shelton, reports The Seattle PI.com.

According to the report, a car driven by a 32-year-old Olympia man was driving an SUV at speeds of up to 60 miles per hour when it rear-ended the school bus that had slowed to turn onto Highway 101.

Luckily there were no children on the school bus at the time of the school bus accident. The school bus driver complained of a sore neck and back after the accident which may be symptoms of a whiplash injury.

Witnesses told police they saw the SUV speeding and weaving prior to the accident and the SUV may have not even braked when it hit the bus.

Bellevue Police Department to conduct DUI emphasis patrols

October 26, 2010 by The Farber Law Group

The Bellevue Reporter reports that the Bellevue Police Department will conduct DUI emphasis patrols in Bellevue on October 28th.

According to the report, the patrols will target motorists between the hours of 5 and 9pm.

Dubbed the "Happy Hour" patrol, it is designed to reduce car accidents fueled by alcohol. In addition to Bellevue Police, a Liquor Control Board officer will be visiting restaurants and bars in the area.

In an emphasis patrol, police stop motorists for lesser offenses including seatbelt non-compliance, cell phone usage, speeding and aggressive driving behaviors including unsafe lane changes, tailgating, failing to signal a lane change, and failing to yield the right of way. Studies have shown that by targeting lesser offenses, they can often stop drunken drivers before a motor vehicle accident occurs.

In Washington State, the Blood Alcohol Content (BAC) standard for intoxication is 0.08 percent. State vehicle code RCW 9A.20.021, 46.61.502(5) & 46.61.504(5). Define the penalties for DUI offense.

Everett 7-car accident injures 9, including 3 children

October 6, 2010 by The Farber Law Group

At least nine people were injured in an Everett motor vehicle accident on Tuesday night when seven cars were involved in a pile-up.

The Everett HeraldNet.com reports that the car accident occurred on 128th Street SW just west of Fourth Avenue West around 6pm.

Three children were injured in the motor vehicle accident including a 15-year-old girl, 7-year-old-girl and a 15-month-old girl. Six adults were also taken to the hospital. The report says it does not appear that any of the injuries are life-threatening.

Apparently the chain-reaction accident occurred after one vehicle hit several others. Police are investigating. Generally speaking, in rear-end collisions, it is the vehicle in the rear that is responsible.

In multi-car collisions such as this, it gets very complicated determining fault. Washington state like many states uses the doctrine of "Comparative Negligence." Everyone involved in the accident may bear a a varying percentage of fault. In fact more that one person may be held responsible for the accident depending on how much they contributed to the accident. This is when an experienced motor vehicle accident attorney can help.

According to the report, the woman was struck by a Ford Taurus as she crossed at the intersection of Bel-Red Road and 120th Avenue Northeast on Monday morning.

The article did not say what caused the woman to be hit but her injuries did not appear to be life-threatening.

Every year, more than 100,000 pedestrians are struck and injured in pedestrian accidents and approximately 5,900 pedestrians were killed.

Washington State vehicle code RCW 46.61.235 -- Crosswalks -- maintains that a vehicle must stop and remain stopped to allow pedestrians or bicycles to cross the roadway within an unmarked or marked crosswalk when the pedestrian or bicycle is within one lane of the half of the roadway upon which the vehicle is traveling or onto which it is turning.

Bellingham tot killed in pedestrian accident, teenage driver arrested

October 1, 2010 by The Farber Law Group

A small girl was killed in a horrible Bellingham pedestrian accident around 2:40pm on Thursday as she was walked in a crosswalk with her mother and her two siblings, ages 5 and 8.

The Seattle PI.com reports that the mother of the toddler was walking her children home from school when a car stopped to let the pedestrians cross. According to the report, a second vehicle driven by a teenage girl rear ended the stopped car, pushing it forward, killing the toddler and injuring her mother.

bellingham pedestrian accident attorneyThe small child was killed at the pedestrian accident scene. Her mother was taken to St. Joseph Hospital for treatment of undisclosed injuries.

The teenage girl driving the second vehicle was arrested for investigation of Vehicular Homicide. She was distracted in the rear-end accident and police are trying to determine whether she was using a cell phone at the time. To hit the first car with such force, the teenager driver may have been speeding as well.

Washington State vehicle code RCW 46.61.520 -- Vehicular Homicide -- provides that a driver can be charged with Vehicular Homicide if a person dies as a result of the negligent operation of a motor vehicle. This includes driving recklessly, driving under the influence of alcohol or drugs or driving without regard for the safety of others.

At least one study found that using a cell phone while driving is equivalent to driving while intoxicated. The study, "Human Factors: The Journal of the Human Factors and Ergonomics Society" found that drivers who were using cell phones braked more slowly and were more likely to be involved in a motor vehicle accident.
