Two killed, 1 injured when car crashes into a Union Gap mobile home

Roger Guerrero, 22, and his 15-year-old passenger, Israel Cabada, were killed in a Union Gap car accident when Guerrero lost control of his Mitsubishi Lance and hit a mobile home. Maximilliano L. Rivera, 15, a second passenger in the vehicle was injured. All three people in the car were from Yakima.

The car accident occurred in the 600 block on Valley Mall Boulevard around 8:40pm. Police believe that excessive speed was a factor in the motor vehicle accident. It is unknown whether alcohol or drugs were a factor. All three were wearing seat belts.

Washington bill seeks to increase penalties for Vehicular Assault and Homicide

House Bill 1646 sponsored by Representatives Orcutt, Ahern, Pearson, Hope, Kippert and McCune seeks to increase the penalties for Vehicular Homicide and Vehicular Assault.

Vehicular Homicide can be charged if a person is killed in an automobile accident and the driver was driving under the influence of alcohol or drugs, driving recklessly or driving without regard to the safety of others.

Vehicular Assault
can be charged if a person is seriously injured in a motor vehicle accident and the driver driving under the influence of alcohol or drugs, driving recklessly or driving without regard to the safety of others.

If passed, the HB 1646 would raise the serious rankings of Vehicular Assault and Vehicular Homicide and increase the standard sentencing range for a first offense as follows:bellevue motor vehicle accident attorney

  • Vehicular Homicide (DUI) - changes the sentencing range from 31-41 months to 78-102 months
  • Vehicular Homicide (Reckless) - changes the sentencing range from 21-27 months to 78-102 months.
  • Vehicular Homicide (Disregard) - changes the sentencing frange from 15-20 months to 21-27 months.
  • Vehicular Assault (DUI) - changes the sentencing range from 3-9 months to 12-14 months.
  • Vehicular Assault (Reckless) - changes the sentencing range from 3-9 months to 12-14 months.
  • Vehicular Assault (Disregard) - changes the sentencing range from 1-3 months to 3-9 months.

DUI driver who struck 5 pedestrians in Seattle's Belltown sentenced

The drunk driver who hit five pedestrians after they left a life show at the Seattle's SODO Showbox on October 28, 2010 has been sentenced after pleading guilty to three counts of vehicular assault (Washington state vehicle code RCW 46.61.522) and one count of reckless driving (vehicle code RCW 46.61.500).

Juanita L. Wright, 42, was sentenced to 29 months by Judge Bruce Heller at the King County Courthouse. The prosecutor's office says this is the "hiigh end" of the sentencing range.

Wright's blood alcohol content was more than three times the legal limit and measured 0.29 percent at the time of the Seattle pedestrian accident. Her vehicle was littered with high-alcohol beer containers.

People writing comments on the Seattle Times blog were irate at what they considered a lenient sentencing. One of the victims in the accidents suffered a critical brain injury and had to have part of her skull removed after the accident.

The Washington state legislature currently has several bills before them involving drunk driving and some of them seek to increase the penalties.

Quincy man killed in roll-over car accident, passenger injured

The Wenatchee World reports that Luis A. Rodriguez, 18, of Quincy, was killed and his passenger, Jose Mendoza, suffered chest injuries and bruises in a rollover car accident on Highway 28 three miles east of Quincy.

According to he report, Rodriguez crossed the centerline, crashed into a ditch, causing the car to roll. The car landed on its wheels about 30 feet from the roadway.

The article did not say whether speed, or alcohol were factors in the car accident.

7 injured in series of Lakewood car accidents on I-5

There were four car accidents on Interstate 5 in Lakewood around 4:30pm this afternoon. There were 11 vehicles involved and seven people suffered injuries. There was one accident involving four cars, another one involving three cars and two accidents involving two cars each.

In an article in the News Tribune of Tacoma, Stacia Glen wrote that Guy Gill, speaking for the Washington State Patrol, said the weather was to blame as there was sun glare on the road.

The previous day, I was headed out of town and I was traveling on Interstate 405 in Bellevue. I witnessed two 3-car accidents in the northbound lanes within a mile of each other on the stretch of the road through downtown. The sun wasn't glaring.

Last week, there was a fatal car accident on I-405 in Bellevue involving an Issaquah teen. In that case, the young driver did not anticipate slowing cars on the highway.

In my 30 years experience representing victims of car accidents, I believe that most accidents could be avoided if:

  • drivers slow down
  • drivers leave sufficient distance between their car and the car in front of them
  • drivers stay attentive to the road conditions; if one sees brake lights up ahead, then for gosh sakes, slow down.

Car accidents are costly. Not only is repairing a car an expensive proposition but the real cost is the injuries that people suffer and the grieving families left behind when a person is killed. Even minor fender benders can result in whiplash that can account for thousands of dollars in medical bills and years of pain and suffering.

Redmond bicyclist charged with malicious mischief

King County prosecutors have filed first-degree malicious mischief charges against Chad W. Olson, 42, who allegedly caused almost $6,000 damage to a Volvo in what is being described as a case ofr "road rage."

According to an article in the SeattlePI.com written by Levi Pulkkinen, Olson threw his bicycle at a Volvo after the Volvo's driver honked his horn at him on October 16, 2010. The Volvo's driver said that he laid on his horn after Olson swerved into his lane from the bicycle lane. Then, according to the Volvo's driver, Olson charged after the Volvo and when it was stopped at a light, he spit on the car, hit the mirror and threw his bicycle at the side of the car.

Olson later went to the Redmond Police Department to report a road rage incident. However, in examining the damages to the Volvo, they were not consistent with Olson's version of the story.

Washington State RCW 9A.48.070 "Malicious mischief in the first degree" finds that a person is guilty of malicious mischief if he or she knowingly causes physical damage to the property of another in an an amount which exceeds five thousand dollars and is considered a Class B felony. A Class B felony has a maximum penalty of 10 years in prison and $20,000 fine.

Man dies after Beaverton bicycle accident

Michael Brett Lewis, 47, of Beaverton Oregon was killed in a bicycle accident on Saturday around 6:30pm reports The Columbian. According to the report, the bicycle accident occurred near the intersection of SW Tualaway Ave and SW TV Hwy.

Apparently Lewis was in the westbound lane when he was hit from behind. Witnesses said that Lewis was stopped in the middle of the lane and that an oncoming car did not see him until it was too late. The weather conditions -- dark and raining heavily -- may have prevented the motorist from seeing Lewis.

Lewis was not wearing a bicycle helmet when he was hit.

Every year there are approximately 900 bicycle accident fatalities. The Consumer Product Safety Commission states that wearing a bicycle helmet decreases the chance of a fatality by 85%.

Man airlifted to Harborview Medical Center after Whidbey Island pedestrian accident

William Lamson, 20, was critically injured in a Oak Harbor pedestrian accident when he was hit by a motorcycle and then by a Subaru on Thursday evening around 7:30pm. Lamson suffered critical injuries in the pedestrian accident and was airlifted to Harborview Medical Center in Seattle.

The pedestrian accident occurred on Regatta Drive near Highway 20 when Lamson was refueling his vehicle. He was hit by a Yamaha motorcycle driven by John Newell, 22 of Oak Harbor. Lamson and was in the roadway where he was then hit by a Subaru Legacy driven by Ryan Wright, 23.

Newell was also injured in the accident and was taken to Whidbey General Hospital.

Police are investigating who was responsible for the pedestrian accident. It is unclear whether Lamson was standing on the road shoulder or if he was out in the street. Police are investigating. At this point it does not appear as if alcohol or reckless driving were factors according to the report in the Seattle PI.

Tow truck driver hit and killed in Highway 14 accident near Vancouver

The Columbian reports that a man was killed in a Highway 14 accident in Vancouver when he was standing on the shoulder after preparing to tow a disabled pickup truck.

The report said that driver had just finished hooking up tow lights on the disabled pickup truck when he was hit.

The driver of the car that hit the man stopped.

Police are investigating the motor vehicle accident.

Emergency responders risk their lives to help others. Motorists should exercise extreme caution when they see flashing lights and disabled vehicles; fiddling with the radio, talking on a cell phone or other actions can contribute to a catastrophic motor vehicle accident such as this one.

Red light cameras reduce fatal red light running car accidents by 24% says study

The Insurance Institute for Highway Safety (IIHS) released the results of a study today which found that red light cameras reduce fatal car accidents. The IIHS study looked at 99 cities with greater than 200,000 population and compared them with the cities of comparable size without red light cameras. The study said:

Based on that comparison, the researchers concluded that the rate of fatal red light running crashes in cities with cameras in 2004-08 was 24 percent lower than it would have
been without cameras.

seattle car accident lawyerThe study also found that, in the cities where the red light cameras were installed, the were fewer fatal red light running accidents in all of the red light intersections, not just at the intersections where the cameras were installed.

According to the National Transportation Safety Administration traffic accident database, there were 676 people killed and 113,000 people injured in red light runner car accidents in 2009.

Those opposed to red light cameras and the tickets issued often portray the driver the victim when issued a ticket. However, the real victims are the people maimed and killed by red light runners.

2009 Fatal Red Light Runner Car Accident Statistics

These statistics paint the true portrait of the red light runner.
  • 10% of the drivers in were teenagers.
  • 11% of the drivers killed were motorcyclists.
  • 22% of the red light runners did not have a valid driver's license.
  • 25% of the red light runners were driving under the influence of alcohol and had a measured BAC of 0.08% or more.
Red light cameras are installed in the 3-Western-most states including Washington, Oregon and California.

Issaquah teen killed in Interstate 405 car accident

Tyler Lucas, 18, of Issaquah, was killed in a Bellevue 3-car accident on Interstate 405 this morning around 10:20am reports the Bellevue Reporter in an article by Celeste Gracey.

According to the report, the teenage boy was driving a Chevy Neon in the left-hand lane on I-405 when he swerved in to the path of a Chevy Suburban to avoid slowing traffic. He was struck by the Suburban which caused his Neon to spin and it was broadsided at the driver's door by a Honda.

The teen was taken to Harborview Medical Center in Seattle but died of his injuries.

The Suburban driver was Peter Gradwohl of Mountlake Terrace; he was treated at Overlake Medical Center. The Honda driver was Shelly Keene of Renton, who suffered only minor injuries according to the report.

Police said that traffic had slowed due to a previous accident on the highway. Sometimes in tragic accidents like this, driver inexperience can be a factor.

In 2009, there were 3,466 teenagers killed in car accidents. This number was 60 percent fewer fatalities than in 2008 according to the National Highway Transportation Safety Administration.

Burien car accident that killed 81-year-old woman may have been caused by red light runner

Pearl L. Berleen, 81, of Seattle, was killed in a Burien car accident last Friday reports The Seattle Times. Police suspect that a driver running a red light was responsible for the car accident.

According to the report, Berleen was driving north on Ambaum Cutoff South when her vehicle was hit by a Dodge Dakota Pickup truck that was headed north on Ambaum Cutoff South.

The force of the impact caused Berleen's vehicle to hit another vehicle.

Berleen was taken to Harborview Medical Center in Seattle where she died. The 61-year-old driver of the pickup truck, a woman from Des Moines, was also admitted to Harborview with serious injuries. The driver of the third vehicle suffered minor injuries in the accident.

Police are investigating the motor vehicle accident and at this point, the Des Moines woman has not been cited.

According to the National Transportation Safety Administration fatal accident reporting system, red light runners killed 676 people in 2009 and injured another 113,000.
