Lost load causes fatal SR 167 motorcycle accident

May 31, 2011 by The Farber Law Group

A motorcyclist was killed in a Auburn motorcycle accident on State Route 167 near the SR 18 interchange around 5pm on Memorial Day.

According to a report by Seattle's King5.com, the motorcyclist was killed when he was thrown off of his bike after rear-ending a car that had stopped suddenly because of a lost load -- a bag of aluminum cans -- that had been dropped on the highway.

Lost or unsecured loads cause more than 400 Washington state motor vehicle accidents every year. Approximately 12 million pounds of refuse lost from cars and trucks ends up on the highways every year.

Washington State vehicle code RCW 46.61.655 is a statute which covers lost or unsecured loads. Drivers who lose a load are subject to a fine between $216-$5000 and could also face possible jail time.

The Washington State Patrol are asking anyone with information on whomever dropped the load to contact them.

This information is provided by Seattle Car Accident Lawyer blog, a service of The Farber Law Group. We represent people who have been seriously injured in motor vehicle accidents caused by the negligence of another and the family of those killed with their wrongful death claims.

Tacoma man arrested in I-5 hit-and-run accident that injured 4 women

May 30, 2011 by The Farber Law Group

A Centralia hit-and-run car accident on Interstate 5 injured 4 women late Saturday night. Four women between the ages of 58-71 all suffered back injuries when the car they were riding in was rear-ended by a driver who then fled the accident.

The Olympian reports that a Tacoma man, 30, was speeding in a Mitsubishi Montero on northbound Interstate 5 when he rear-ended a Cadillac driven by a 58-year-old Rochester woman. The Tacoma man then fled the accident scene by foot.

Four women in the Cadillac were taken to Providence Centralia hospital for treatment of back injuries.

The Centralia K-9 unit apprehended the Tacoma man and he faces charges of DUI, reckless driving, hit-and-run among others offenses.

Often a rear-end car accident can leave the victim with whiplash injuries. Whiplash injuries is a descriptive term for hyperflexion/hyperextension injury and occurs when the vehicle is pushed forward on impact and the victim's head snaps backwards. Because the movement is violent and is outside of the neck's normal range of motion, muscles in the neck and upper body are damaged.

The victims in this car accident would be well-advised to contact a personal injury attorney who can determine whether the driver that hit their car was insured.

This information is provided by Seattle Car Accident Lawyer blog, a service of The Farber Law Group. We represent people who have been seriously injured in car accidents including those with whiplash injuries.

I-90 bus-car accident kills 2, injures 21 others near Cle Elum

May 29, 2011 by The Farber Law Group

A Washington state tour bus accident on east bound Interstate 90 outside of Cle Elum killed Ciro R. Astudillo, 51, and Virginia Ocamposoriano, 45, both of Pasco, and injured 21 others on Saturday evening. The bus accident occurred around 6pm on as the chartered bus traveled from Seattle to Moses Lake, Washington.

The bus was returning to Eastern Washington from Seattle's Qwest field where passengers on the bus had attended a soccer match between Mexico and Ecuador.

According to a report, the bus driver. Elmer Schuman, 67, attempted to change lanes from the right into the left lane and cut off a passenger car, a Hyundai Elantra. It appears as if the bus driver over corrected and hit a GMC truck stopped on the side of the road, causing the bus to flip.

The passenger car that swerved to avoid the bus ended up rolling over three times and landed upside down in the median. The female passenger and a toddler in the Elantra apparently suffered minor injuries.

The GMC truck driver, Jeffrey R. Irmer, 24, of Spokane suffered a serious leg injury and he was airlifted to Harborview Medical Center in Seattle.

In all, 21 people were injured in the bus accident. 9 of the bus crash victims were hospitalized at Kittitas Valley hospital including a 16-year-old boy and a 2-year-old girl.

Driver error is often a factor in bus accidents. In this accident, the bus driver will be tested for the presence of alcohol or drugs but an investigation will also determine if the driver lacked the proper training or was distracted.

The National Transportation Safety Board Chairman has criticized the bus industry saying that buses are not equipped with the advanced safety features available in passenger vehicles including adaptive cruise control and electronic stability control. The lack of safety features built-into buses coupled with a lack of seat belts can make bus crashes deadly.

May 28, 2011 by The Farber Law Group

The Spokesman-Review reports that Eileen C. Jensen was not criminally negligent in the death of her daughter who was fatally injured in a Spokane car accident. Vehicular homicide charges were brought against Jensen because her baby's car seat was improperly installed.

What is the statute of limitations for filing a lawsuit after my car accident?

May 25, 2011 by The Farber Law Group

Many people ask us, "What are the statute of limitations for filing a lawsuit after being injured in a car accident?"

In Washington State, the law sets a three year time limit from the date of a motor vehicle accident to file a personal injury lawsuit. However, there are exceptions based on the facts.

If you have been involved in a car accident and your injuries are serious, you should consult with an experienced Washington personal injury attorney to make sure your rights are protected. Even though your statute of limitations may not expire for several years, by hiring a personal injury attorney promptly, you can maximize the value of your personal injury claim and make sure you avoid mistakes like not documenting your injuries and treatment correctly and also not getting the full value of witnesses to your accident.

Ford F-150 and Toyota Tundra large pickups earn top rating in roof strength test

May 16, 2011 by The Farber Law Group

The Insurance Institute for Highway Safety reports that the Ford F-150 and Toyota Tundra are the only large pickup trucks on the market to earn their top rating of "GOOD" in roof strength evaluations.

Roof strength is an important safety feature because, in rollover motor vehicle accidents, the roof protects the vehicle occupants from serious injuries. According to the IIHS, 10,000 people are killed every year in rollover car accidents. The Institute has found that by increasing the roof strength, there is an estimated 50 percent reduction in serious and fatal injuries in rollover motor vehicle accidents.

The IIHS tests a vehicle's roof strength by pushing a metal plate against one corner of a vehicle's roof. The maximum force before the roof is crushed 5 inches is measured and compared with the vehicles weight.

The Nisan Titan received an Acceptable rating while the Chevrolet Silverado and Dodge Ram only received a Marginal rating.

For more information, see the IIHS web-site.

Man critically injured, woman killed in Interstate 5 car accident at Arlington

May 10, 2011 by The Farber Law Group

A 75-year-old Blaine woman was killed and a 87-year-old Camano Island man, Robert L. Gwaltney, with whom she was riding was critically injured when their Honda was rear-ended by a semi truck on Interstate 5 near Arlington at 3:30am today reports The Herald Net.com of Everett. Gwaltney, who was driving, was airlifted to Harborview Medical Center in Seattle.

According to the report, the Honda was in the far right southbound lane of I-5 and was either barely moving or stopped. The semi truck was driven by a 44-year-old Stanwood man. He was unable to stop or avoid hitting the Honda.

The impact of the collision forced the Honda across all lanes of traffic until it stopped in the median.

The Highway patrol is investigating why the Honda was moving so slowly. Hopefully they will determine whether a medical issue or a malfunction in the vehicle was the cause. The report said that alcohol was not a factor.

Two seriously injured in motor vehicle accident when car and bus collide

May 6, 2011 by The Farber Law Group

Two people were taken to Harborview Medical Center in Seattle after a Lynnwood motor vehicle accident involving a Community Transit bus.

The HeraldNet.com
of Everett reports that the car accident occurred on Highway 99 near 40th Avenue West around 9am when a car driven by Yollymar Delgado, 22, of Lynnwood, turned into the path of an oncoming bus.

Delgado and his passenger, a woman, were thrown from the car. Their injuries appeared to be serious.

The force of the impact caused Delgado's vehicle to be pushed into a car driven by a 17-year-old boy also from Lynnwood. The teen complained of neck and back pain and he was taken for treatment at an area hospital.

Delgado most likely will be cited with vehicle code RCW 46.61.185 "Vehicle Turning Left" which states that a vehicle turning left within an intersection shall yield the right-of-way to any vehicle approaching from the opposite direction.

It is really unfortunate that Delgado and his passenger were apparently not wearing seat belts at the time of impact. Seat belts prevent motorists from being thrown from vehicle which prevents very serious injuries.

Maple Valley car accident injures 2

May 5, 2011 by The Farber Law Group

Two people were injured in a Highway 169 head-on Maple Valley car accident on Wednesday.

The Seattle Times reports that the driver of a southbound vehicle lost control and crossed the centerline line, causing the head-on collision.

A third vehicle was also involved in the accident.

Both drivers involved in the head-on collision were taken to area hospitals and are expected to recover.

Head-on car collisions result in the highest number of fatalities because the combined forces are so high. Although head-on car accidents account for about two percent of crashes, they account for more than 10 percent of fatal automobile accidents.

Property damage is also usually very high with most vehicles declared a total loss by the insurance companies. For example, if both vehicles are traveling at 50mph, the combined speed equals 100mph. Head-on collisions are often caused when vehicles are passing, speeding or driver inattention.

This information is provided by Seattle Car Accident Lawyer blog, a service of The Farber Law Group. We represent people who have been seriously injured in motor vehicle accidents and the family of those killed.

Lynnwood woman injured in car accident when car hood flies up

May 3, 2011 by The Farber Law Group

The Herald Net.com reports that a 20-year-old Lynnwood woman was seriously injured in a Everett car accident on northbound Interstate 5 on Thursday night when her car's hood became unlatched. The woman was driving a Volkswagen Beetle and her view was obstructed by the hood.

According to the report, she swerved and her vehicle was hit by a bus.

The woman was taken to Harborview Medical Center in Seattle where her condition has been upgraded from the intensive care unit.

This type of motor vehicle accident occurs in different forms on a far too often basis. This driver was lucky. We have seen other cases in which a driver has lost a load which obstructed a driver's view and caused an accident or snow and ice left on top of a car becomes dislodged and obstructs a driver's view.

In this case, if a mechanic failed to properly fasten the hood latch of the woman's vehicle, the mechanic may be liable for damages.
