Driver who was injured when trucker loses wheel awarded $12.29M accident settlement

Gordon Burin, 51, was awarded a $12.29M injury accident settlement for an accident that left him with a traumatic brain injury and neck and back injuries. Burin's medical expenses after the accident were $235,100.

Burin was driving on an interstate highway when a truck lost a wheel from its axle. Burin struck the wheel and the jolt caused him to hit his car's ceiling. Burin underwent surgery for his back and neck injuries but the traumatic brain injury let him with diminished memory and cognitive abilities and caused a change in his personality. His brain injury left him unable to work as a commercial airline mechanic.

Vicarious Liability

Burin and his wife filed suit against the truck driver for negligence and also the owner of the truck alleging vicarious liability. Vicarious liability -- respondeat superior -- is a legal doctrine that holds a person or a company liable for the action of an employee in the course of their employment.

Lost Wheel Accidents

When a vehicle traveling at high speed loses a wheel, the results are often catastrophic. Sometimes a lost wheel will crash through a vehicle windshield. When the a lost wheel accident involves a commercial vehicle, authorities look at the trucking company's safety and maintenance records to insure the vehicle passed appropriate inspections as wheels do not normally come off of vehicles.

In this case, the jury must have felt that the truck driver and truck driver were negligent in maintaining the truck in finding the defendants jointly and severally liable.

Estate of woman killed by trucker who fell asleep at the wheel receives $4.8M wrongful death award

When a passenger vehicle and a semi truck collide, more than likely the driver of the passenger car will be the one who suffers serious injury or death. Case in point is the trucking accident that result in the wrongful death case of Doe V. Roe Trucking Co.

Doe, 54, was stopped in traffic when a semi truck driver, who had fallen asleep at the wheel, smashed into the rear of her car, killing her. Imagine her terror as she saw a 10,000 pound trucking bearing down on her. At the time of her death, Doe was working as a vocational counselor, a job that paid her $120,000 annually.

Doe's sister, on behalf of Does's estate filed a wrongful death lawsuit against the truck driver and the trucking company he worked for claiming negligence was responsible for Doe's death. Doe and Roe settled for the wrongful death case for $4.8 million which was to be paid by the Roe's insurance company.

In this case, the plaintiff's attorney, representing Doe's estate did an investigation into the truck driver. The U.S. judicial system allows that prior to a trial, each party in a lawsuit can obtain evidence by means of discovery. Discovery can include asking for documentation of the truck driver's previous driving history, his medical records, his trucking log, his cell phone records and also asking him to answer question to interrogatories. In a lawsuit, the court can compel the defendant to assist in discovery.

In the case of Does v. Roe, it was revealed in discovery that, prior to the trucking accident, Roe was tested for and was diagnosed with a "moderately severe" case of sleep apnea, a condition in which a person stops breathing many times during night time sleep which causes daytime fatigue, slower reaction time and other problems.

It was also revealed in discovery that Roe had a history of motor vehicle accidents and had been involved in six accidents before the accident involving Roe.

The plaintiffs claimed in the wrongful death suit that Roe Trucking Co. was negligent in employment. An employer can be held liable for the actions of an employee if the employer was negligent in entrusting an employee with a dangerous instrument.

Wrongful death statutes

Many states have a wrongful death statute. The Washington State wrongful death statute allows the family of a person who was killed by another person's negligent act to recover compensation in a civil action. Wrongful death cases often arise from motor vehicle accidents but they can also arise from on-the-job-accident, criminal attacks, school sporting activities and dangerous products.

Before Filing A Personal Injury Claim

If you’ve been hurt in an accident and you feel another party is to blame, you may want to file a personal injury claim. There is some information you should know however before doing so.

First of all, it’s important that you let the responsible for the accident know you believe they are responsible before you file your claim. You don’t necessarily have to know for sure who is responsible, but you have to have an idea. In the first part of your personal injury claim you don’t have to give anyone including insurance companies any information about your accident. Just simply state what happened and where, that you were hurt in this particular accident, and that you intend to file a personal injury claim.

If you aren’t exactly sure who is responsible or who you should notify about your personal injury claim, then notify everyone who may be responsible. Depending on what kind of accident you were in is going to depend on whether you know who exactly is to blame. In a car accident, for example, you probably know for sure that the other driver is to blame; if you are hurt in a company with a lot of employees, you may not know.

The correct way to let all parties know you intend to file a personal injury claim is to write letters informing them of your accident. Be sure to let them know you were injured. In some cases, it may be necessary to write and send more than one letter. For example, if you were hurt in a place of business, you would send a letter to the owner of the business as well as the owner of the property where the business resides.

You do not want to take your time in getting those letters out. There is no time limit, however in order to have the best possible chance to win your personal injury claim, you need to let all parties know as quickly as possible after your accident. Always send your letter through registered or certified mail so you know for certain they received it.

As long as you notify all parties involved prior to the claim, no one will be able to say they were surprises when the time comes for the claim.

Two killed in multi-vehicle accident on I-90 near Snoqualmie Pass

The Washington State Patrol is reporting that two people in a passenger vehicle were killed in an accident on Interstate 90 near the summit of Snoqualmie Pass this morning around 11:50am. At least two semi-trucks were involved in the motor vehicle accident.

While the Washington State Patrol is investigating , it appears from news photos that the passenger vehicle was crushed between two semi-trucks. A third semi-truck may also be involved.

At this point, the cause of the accident has not been determined nor do we know if there are any others injured. However, there is heavy construction on I-90 and the eastbound lanes have been funneled down to one lane for a 6-day period while engineers prepare the opening of a new section of highway.

The construction work on the highway has caused considerable traffic slow-downs and long delays. The Washington State Department of Transportation reports that the accident, near milepost 56, has caused a 7 mile-long traffic backup.

When there is road construction, drivers must pay close attention to speed limits and also to slowing traffic.

King County troopers ticketing cell phone users

A Washington State Patrol media release says King County troopers are enforcing the cell phone ban by stopping and ticketing drivers.

According to the WSP, last month, troopers stopped 370 drivers for using a hand-held cell phone and 43 drivers for texting while driving. More than one half of the drivers were issued a ticket which will cost them $124 for using a hand-held device while driving.

Washington state vehicle code RCW 46.61.667 is the statute that prohibits a motorist from driving while talking on a cell phone. Vehicle code 46.61.668 prohibits reading, writing or sending a text message while driving.

Washington's cell phone ban was effective as of July 1, 2008. The legislature enacted the cell phone laws after the Highway Loss Data Institute cited studies that texting while driving may increase the risk of a car accident by 23 times.

The Washington State Department of Transportation has found that emphasis patrols, whether they are targeting drunken drivers, seat belt violators or cell phone users saves lives.

Safety improvements to SUVs saves lives

In the past, when an SUV and a car collided, the occupants of the car were at a much greater risk of serious injury or death. One reason was that SUVs and pickup trucks had bumpers higher off the ground and would override the smaller vehicle in a collision.

A new study done by the Insurance Institute for Highway Safety shows that the fatality rate to people in cars in collisions with larger vehicles has been dropping due to the redesign of SUVs to align their front-end designs with other vehicles. Electronic Stability Control (ESC) built into SUVs have also made them more stable and less prone to crash.

At the same time SUVs and pickup trucks were made safer, passenger cars and minivans were also being improved with safety features such as side airbags and improved structural strength.

Starting in 2003, the major automobile manufacturers at the recommendation of the National Highway Traffic Safety Administration redesigned the front-end of pickup trucks and SUVs so that their energy-absorbing structures aligned with those of cars so that, in a collision, the larger vehicle would not override the car. This change along with side airbags and increased structural strength in cars and minivans has caused the fatality rate to drop from 44 deaths per million vehicles in 2000-2001 to 16 deaths per million vehicles in 2008-2009.

Many of the major automobile manufacturers participated in redesigning their SUVs and trucks including Ford, General Motors, Chrysler, Honda, BMW, Mazda, Volkswagen and Toyota.

WSP to step up seat belt patrols in Bellevue, Clyde Hill and all of King County thru June 5

The Bellevue Reporter reports that local law enforcement agencies working in conjunction with the Washington State Patrol are stepping up their enforcement of seat belt laws between May 23 and June 5.

Police departments involved in the "Target Zero" seat belt emphasis patrols include : Auburn, Bellevue, Black Diamond, Burien, Clyde Hill, Covington, Federal Way, Issaquah, Kent, Kirkland, Maple Valley, Mercer Island, Newcastle, North Bend, Pacific, Redmond, Renton, SeaTac, Seattle, Snoqualmie and Tukwila.

Seat belt law emphasis is one proven way to reduce traffic accident fatalities. Studies show that drivers who fail to use a seat belt also engage in other risky behaviors. By concentrating on seat belt enforcement, aggressive driving, distracted driving, equipment violations and speeding, law enforcement can reduce traffic accidents and fatalities.

Washington state has a seat belt compliance rate of nearly 96% which is one of the highest in the nation.

Ford F-150 and Toyota Tundra large pickups earn top rating in roof strength test

The Insurance Institute for Highway Safety reports that the Ford F-150 and Toyota Tundra are the only large pickup trucks on the market to earn their top rating of "GOOD" in roof strength evaluations.

Roof strength is an important safety feature because, in rollover motor vehicle accidents, the roof protects the vehicle occupants from serious injuries. According to the IIHS, 10,000 people are killed every year in rollover car accidents. The Institute has found that by increasing the roof strength, there is an estimated 50 percent reduction in serious and fatal injuries in rollover motor vehicle accidents.

The IIHS tests a vehicle's roof strength by pushing a metal plate against one corner of a vehicle's roof. The maximum force before the roof is crushed 5 inches is measured and compared with the vehicles weight.

The Nisan Titan received an Acceptable rating while the Chevrolet Silverado and Dodge Ram only received a Marginal rating.

Senate Bill calls for impounding cars of drunk drivers

Washington state Senate Bill 5000, which mandates impounding the car or truck of drivers who have been arrested for driving under the influence, just passed the senate by unanimous vote. The bill states that vehicles of suspected DUI drivers be impounded for a 12-hour period after the driver's arrest.

The bill was sponsored by Sen. Mary Margaret Haugen, D-Camano Island. Haugen said:

"This addresses a serious threat to public safety. Under our existing laws, it's possible for someone to be cited for drunken driving, return to their car while still intoxicated, and resume driving. It happens, and it's a danger to other drivers."

The bill does allow for another title holder on the vehicle to pick up the vehicle before the 12 impound hold ends.

Courts to allow access to State Patrol and DOT accident records

The Washington Court of Appeals released an opinion last week that gave citizens the right to access motor vehicle accident records collected by the Washington State Patrol and provided to the Washington Department of Transportation (DOT) under the Public Records Act.

The case came before the court when a bicycle accident victim sued to see DOT records concerning Seattle bicycle accidents on the Ship canal bridge but the state refused the records release unless the accident victim certified that he would not use the data in a lawsuit against the state.

The bicycle accident victim, Mickey Gendler, argued that under the Public Records Act citizens have a right to access the records and obtain information about unsafe road conditions.

It can be argued since State can obtain identifying information from citizens when they are using the roadways by acquiring information from red light cameras and transponders then the citizen has a right to obtain information about those roadways and their accident rates. "People will be able to get these kinds of records and pressure the state to do something about an unsafe condition," Gendler said. In our opinion, the State should be using information gathered about unsafe road conditions to ameliorate the problem, not to shield itself from a potential lawsuit.

2009 car accident statistics reveal 33,808 fatalities

The Insurance Institute for Highway Safety (IIHS) reports that 33,808 people died in motor vehicle accidents in 2009.

The IIHS just published car accident data for the year 2009. The statistics are from data collected by the US Department of Transportation's Fatality Analysis Reporting System (FARS).

The following information was gleaned from the report:

Alcohol Related motor vehicle accident fatalities
- A driver's Blood Alcohol (BAC) increases the probability of a fatal accident. While 0.08% is the legal limit for intoxication in Washington state, the probability of a fatal accident rises significantly after 0.05%.

Bicycle accident fatalities - 630 bicyclists were killed in accidents with motor vehicles in 2009 which is a decline by 37% since 1975. Every year, more male bicyclists are killed than female.

Child Fatalities - In 2009, 1,062 children died in motor vehicle accidents. This was a 1% increase over the previous year but a 71% decline since 1975. Child safety seat laws, vehicle air bags, and placing children under the age of 12 in the back seat, have all been factors in reducing the death rate.seattle car accident attorney

Fixed object accidents -
In 2009, 7,800 people were killed in motor vehicle accidents which involved hitting a fixed object. About 20% of fatal car accidents occur when a driver loses control of the vehicle and hits a fixed object like a tree, traffic barrier or utility pole. Alcohol is often a factor in these types of accidents.

Motorcycle accidents - In 2009, 4,281 motorcyclists died in accidents. Fatal motorcycle accidents started declining in the early 1980s but starting in 1998, they increased through 2008. Last year, motorcycle accident fatalities decreased by 16% but accounted for 13% of all motor vehicle crash deaths. Head injuries are the leading of death in motorcycle accidents so helmet use is essential.

Pedestrian accidents - 4,409 pedestrians were killed in motor vehicle accidents in 2009. Pedestrian accident deaths account for 12 percent of motor vehicle accident deaths. People ages 70 and over are the highest at risk.

Teenage motor vehicle accidents - 3,466 teenagers between the ages of 13-19 were killed in motor vehicle accidents in 2009. While car accident deaths have decreased every year since 1975, teenagers are four times as likely to die in a car accident based on miles driven than older drives. Most at risk are teenage boys; 2 out of 3 of every teenagers to die in a car accident is male.

Man seriously injured in motor vehicle accident when failing to yield to truck near Moses Lake

Luis Jaramillotavira, 32, of Connell, was seriously injured in a motor vehicle accident when the Plymouth van he was hit by a truck hauling potatoes near the junction of State Route 17 and State Route 170 near Moses Lake.

According to a media release by the Washington State Patrol, Jaramillotavira failed to yield to the potato truck as he made a left turn onto State Route 17.

Washington State Vehicle Code RCW 46.61.185 "Vehicle Turning Left" states that a vehicle shall yield the right-of-way to any vehicle approaching the opposite direction to the intersection or so close thereto as to constitute an immediate hazard.

The WSP has been recognized by the U.S. Department of Transportation for helping to reduce the number of fatal truck accidents in the state. In 2009 there were 3,380 fatal accidents involving trucks in compared with 4,542 in 2008.

So far this year, the State Patrol has seen a continued decrease in the number of fatal truck accidents. The State Patrol says with harvest in full swing that drivers of passenger vehicles should use caution and allow more space for commercial trucks.

The WSP says to use caution when changing lanes, avoid tailgating, maintaining your speed and to signal lane changes.

Oregon woman injured in motor vehicle accident with semi trailer

The Washington State Patrol is investigating the cause of a motor vehicle accident on state Route 8 at Old Olympic highway which injured a 25-year-old Oregon woman, Carmen M. Winkle.

According to The Olympian,Winkle was driving west when her Jeep collided with the trailer of a westbound semi truck driven by Paul K. Yeboah, 48, of Seattle. The motor vehicle accident occurred around 7:57am.

Winkle suffered undisclosed injuries and was taken to Providence St. Peter Hospital. An infant riding in the back seat was not injured. Yeboah was not injured either.

Bicyclist injured in North Seattle accident

A Seattle man suffered a broken femur, head and facial injuries in a bicycle accident in North Seattle on Thursday morning around 6am.

According to The Seattle Times, the bicyclist ran a red light at North 145th Street and 1st Avenue Northeast and was hit by a pickup truck.

The injured cyclist was taken to Harborview Medical Center in Seattle for treatment.

Seattle personal injury attorney discusses causes of rollover car accidents

Every year, there are approximately 280,000 rollover vehicle accidents in the U.S. and approximately 10,000 of these accidents result in a fatality. Rollover accidents, those in which a vehicle tips over onto its side or roof, are some of the most deadly after head-on collisions.

Causes of rollover motor vehicle accidents

The following lists some of the most common causes of rollover accidents:

  • Excessive speed when vehicles turn a corner or travel on a hard curve. Most passenger vehicles will slide or skid in a curve or hard turn if the vehicle is traveling at excessive speed. However, SUVS, vans, pickup trucks, buses and heavy trucks have more of a tendency to rollover over because of their height, higher ground clearance and because of they are more top heavy.

  • Collision with another vehicle. Side impact car accidents are the most likely to cause a vehicle to rollover.

  • Vehicles crossing a ditch or slope. Vehicles can roll especially if they are on a slope that is steeper than 33% grade.

  • Driver over-correcting. If a driver veers out of their lane, they often over-correct – jerking the wheel back in the other direction too forcefully – causing it to flip.

Popular SUVs are more apt to rollover than other passenger cars. In one year – 2003 – Some of the vehicles with the worst rollover record are Ford Broncos II, Suzuki Samurai, Jeep CJ, Ford E-Series, Mitsubishi Pajero/Montero and Isuzu Trooper.

Vehicle manufacturers are working hard to improve vehicle designs to both decrease the likelihood of a rollover accident and to improve the roof structure of the vehicle to protect the occupants from being crushed in a rollover accident.

Seatbelts also play a crucial role in saving lives in rollover car accidents. Seatbelts prevent passengers from being ejected in a rollover accident.

Forks man charged with negligent driving in Highway 101 car accident that injured teen

John Abrahamson, 65, of Forks, faces negligent driving charges in the single car accident in which he suffered a back injury and a broken and possibly inured his passenger, William McBride, 14, of Tenino.

The Olympian reports that Abrahamson was driving a a U-Haul truck on U.S. Highway 101 when he fell asleep and ran off the road, hitting a tree.

According to The Olympian, Abrahamson will be charged with negligent driving.

12-year-old Washington state boy killed in tragic B.C. pedestrian accident

A 12-year-old boy from Washington state has died of injuries he sustained in a pedestrian accident on the Agassiz-Rosedale bridge in the Fraser Valley of British Columbia reports The Vancouver Sun. The boy was hit by a semi truck and was airlifted to a Vancouver-area hospital but he succumbed to his injuries.

The boy was vacationing with his family when the lid of their vehicle's roof-top carrier blew off and the family stopped to search for it. The boy was outside of the family's vehicle when he was hit by the truck.

Log truck hits passenger car near Hoquiam, 2 seriously injured

Two people were seriously injured in an accident involving a log truck and a Chevrolet pickup truck on State Route 101 near Hoquiam on Monday.

According to a report on The Olympian, the pickup truck driven by Rita Billie, 46, of Taholah, made a left hand turn without signaling and the log truck t-boned the pickup truck. The force of the impact caused the log truck to roll and the pickup truck was pushed into a ditch.

Billie received serious injuries including a lacerated liver, broken ribs, broken pelvis, broken back, broken neck and a broken collar bone; She was airlifted to Harborview Medical Center in Seattle.

A passenger in the pickup truck, Jonah Billie, 47, was also airlifted to Harborview with broken ribs, a broken back, broken leg and internal injuries.

Gilroy was not injured in the motor vehicle accident.

Washington Patrol says "Secure your Load" to prevent accidents

The Washington State Patrol, in a media release, reminds motorists to properly secure loads on vehicles or risk a fine of $5,000 and a year in jail time.

Washington State Vehicle Code RCW 46.61.655:

No vehicle shall be driven or moved on any public highway unless such vehicle is so constructed or loaded as to prevent any of its load from dropping, sifting, leaking, or otherwise escaping there from.
Every year in the state of Washington, nearly 12 million pounds of refuse lands on county, state and interstate roads. This refuse is an eyesore, harms our wildlife and can cause traffic accidents. Every year, more than 400 motor vehicle accidents are caused by unsecured loads some resulting in devastating injuries and occasionally death.

Motorists often have the mistaken belief that if they carry something heavy in a pickup truck or trailer, they don't need to tie it down. While a couch, refrigerator or household furniture might not blow out of the back of a truck, the momentum of heavy objects when a vehicle stops can have disastrous consequences.

The Washington State Patrol tells witnesses to lost loads to call 911 immediately and provide the following information:

  • location where you saw the vehicle
  • direction in which the vehicle was traveling
  • the road the vehicle was traveling on
  • description of the vehicle including color
  • vehicle license plate number
  • name of trucking company or other identifying information on the vehicle
  • a description of what you saw
  • identify yourself as a witness or a victim.
Besides calling 911 regarding a lost load, you can report the incident on the WSP web site.

3 injured in I-5 multi-car accident near Centralia

Three people were injured early Wednesday morning around 3:30am in a motor vehicle accident involving two cars and a semi truck on Interstate 5 near Centralia. The accident occurred near milepost 88 in south Thurston County.

The injured were taken to Providence Centralia Hospital.

The accident is blamed on the semi truck driver who apparently hit two cars that had slowed due to construction work.
