Lyle C. Painter IV, 23, has been charged in Pierce County with two counts of Vehicular Assault after the Christmas Day car accident in Tacoma that killed Jennifer Ussery, 36, and Dorothy Jones-Ussery, 74 both of Roy. Both women were riding in a station wagon when Painter hit their vehicle with his pickup truck.
According to the report in The Tacoma News Tribune, the on-board computer on Painter’s pickup truck showed that Painter was speeding at the time of the motor vehicle accident. The data showed that he was traveling at approximately 63 mph right before the accident and the posted speed limit is 35mph.
Vehicular Homicide, RCW 46.61.520, can be charged if someone if a person is killed in a car accident and the driver was driving under the influence of alcohol or drugs, driving with reckless disregard to the safety of others or driving recklessly.
