Washington bill seeks to increase penalties for Vehicular Assault and Homicide

House Bill 1646 sponsored by Representatives Orcutt, Ahern, Pearson, Hope, Kippert and McCune seeks to increase the penalties for Vehicular Homicide and Vehicular Assault.

Vehicular Homicide can be charged if a person is killed in an automobile accident and the driver was driving under the influence of alcohol or drugs, driving recklessly or driving without regard to the safety of others.

Vehicular Assault
can be charged if a person is seriously injured in a motor vehicle accident and the driver driving under the influence of alcohol or drugs, driving recklessly or driving without regard to the safety of others.

If passed, the HB 1646 would raise the serious rankings of Vehicular Assault and Vehicular Homicide and increase the standard sentencing range for a first offense as follows:bellevue motor vehicle accident attorney

  • Vehicular Homicide (DUI) – changes the sentencing range from 31-41 months to 78-102 months
  • Vehicular Homicide (Reckless) – changes the sentencing range from 21-27 months to 78-102 months.
  • Vehicular Homicide (Disregard) – changes the sentencing frange from 15-20 months to 21-27 months.
  • Vehicular Assault (DUI) – changes the sentencing range from 3-9 months to 12-14 months.
  • Vehicular Assault (Reckless) – changes the sentencing range from 3-9 months to 12-14 months.
  • Vehicular Assault (Disregard) – changes the sentencing range from 1-3 months to 3-9 months.
