2-car accident on Highway 101 injures 5, 1 critically

The Washington State Patrol is investigating a Cosmopolis 2-car accident which injured five people under the age of 23 on Highway 101 three miles south of Cosmopolis on Friday night reports KOMO News.com of Seattle. Cosmopolis is a city in Grays Harbor County of around 1,500 people.

The Grays Harbor County car accident occurred around 11:45 when a 20-year-old Montesano woman lost control of the 2007 Toyota Scion she was driving and swerved her car into the path of a Honda driven by a 22-year-old Aberdeen man.

Police believe the driver of the Scion was speeding at the time of the accident and police are investigating her for DUI. She was uninjured in the accident but her passenger — a 22-year-old Aberdeen man — suffered a head injury and tailbone injuries.

The driver of the Honda was not injured but all four of his passengers were injured. A 20-year-old man suffered internal injuries and he was airlifted to Harborview Medical Center in Seattle. A 21-year-old man was taken to Grays Harbor Community Hospital after suffering a scalp laceration and jaw injury. A 17-year-old girl and a 20-year-old man were also taken to Grays Harbor with possible internal injuries. Another 17-year-old girl was taken to Grays Harbor with undisclosed injuries.

If it is determined that the driver of the Toyota was driving under the influence of alcohol or drugs, she faces charges of Vehicular Assault. Washington State Vehicle Code RCW 46.61.522 states that Vehicular Assault can be charged if a person is seriously injured in a motor vehicle accident and the driver was driving under the influence.

In addition to criminal charges, civil claims could be filed against the driver of the Toyota and her insurance company for damages received by the injured parties.

Apparently, one passenger in the Honda was not wearing a seat belt. Washington’s seat belt law requires that everyone riding in a car be properly seat belted. Passengers that are 16 year of age are older, however, are responsible for themselves and could be cited.
